52 Year Old Man Exposes Himself to Clerk While Shopping in Womens UnderWear Section and Trying On Items

Detectives charged a 52-year-old Arlington man with indecent exposure at a shopping mall dressing room and have connected the suspect to a similar incident last month.
Allen Jones, 52, of Longfellow Street in Arlington, reportedly exposed himself to a clerk at the JC Penny’s at Springfield Mall around 11:15 a.m. on Monday, October 5. The suspect was shopping in the women’s underwear section of the store and requested assistance from the clerk as he shopped and tried on the items. The incident reportedly took place in the changing room. The clerk immediately contacted police and store security.
Upon investigation, detectives linked the suspect to a previous incident on September 18 where the suspect similarly reportedly exposed himself to a clerk at a women’s lingerie store (Soma) in the Mall. The suspect was charged in connection with that event as well.
Jones was transported to the Fairfax County Adult Detention Center.

Isn’t it against the law now, for stores to define their merchandise as women’s or men’s, as in the Women’s Department or the Men’s Department; and isn’t it also, now against the law to deny a self-defined transgender access to whichever changing room he desires to use? If this is true, then the Virginia statute which defines “indecent exposure” may have been misapplied by the police officers and they may get sued.
If their is present which the Supreme Court chose not to consider when deciding the recent transgender discrimination case (or whatever they decided), can they be sued?
