charged with possession of alcohol (underage)

It's a $130 fine. Other than being on my record, is there anything else that goes along with this? I'm 19, so underage, but over age 18 of course.

Is it on my record forever?

You're over 18, quite simply: Yes it's there forever.

No employer will care though. Just don't get too many of those charges in the next couple of years and you'll be fine.

You can petition the gov't to have it expunged... Send a letter along the lines of "I here by order any public safety employee to expunge mi records", they are good about doing it. That's how I got all my charges cleared, just sent them a letter.

i had it reduced to DIP and removed after the probation period was over.

That's totally false information. I know people with misdemeanor criminal records (stuff like drunk in public, disorderly conduct, etc) who hold Top Secret/SCI clearances.

But the OP should be okay if he/she is a 3rd or more generation American. Because as we all know, they are more patriotic than other Americans.

Yeah. And as long as you were drinking AMERICAN beer or whiskey, your ability to obtain a clearance will be fine. Something like Bud Lite or MGD. But don't let them find out you were drinking something like French wine or they'll pull your clearance in a heartbeat and send your socialist ass back to Russia where it belongs, punk!

Yup, it's right on the OPM website. A huge flash animation that says "We condone theft and underage drinking". They also provide some good info on how to increase your skills as a thief.

In most states you can apply to have your record expunged of misdemeanor infractions after certain number of years (each state differs). However, in The Commonwealth of Virginia all convictions will remain on your record for LIFE. In brief, in Virginia expungement is only available to people who are innocent of the charge, this means if you are found guilty you will be permanently ineligible for an expungement petition. In D.C. you can have violent felonies removed after 10 years rather easily with a decent lawyer. In Virginia, you'll have to explain that misdemeanor to future employers for the rest of your life.

i can either pay it off or appear in court. Is there any value in going to court? I am guessing there is the chance to get it reduced. But how good are those chances? Are there court fees? I know I can get a court ordered lawyer, is that a charge at all or free? I was under the impression its free (its a freakin right), but you never know anymore, I wouldn't be suprised if I had to somewhat pay for it.

also the court date is set for after I go to school, any way to get the date changed?

I think it's like 10 bucks. It's a little bit over kill though, I doubt you need it, just plead no contest.

You may not be able to qualify for security clearances until 5 years after a misdemeanor charge. If you've been found guilty of fraud though it could be very difficult to every get a clearance. Same thing with drugs...if you've used but not for several years as long as you're honest in the pre-polygraph interview you'll be okay.

But try not to fuck up too much if that's a possible avenue you're looking to go down.

Yeah the judge may give you a deferred sentence. I suppose you could ask for it by name, if you are going to get a lawyer they will probably ask for the same thing. Basically it is probation with community service, but if you complete all of it without getting in any more trouble, you will be cleared of your charge.
Even if it doesn't clear you are fine, no one really gives a shit about minor in possession.

You have a right to a lawyer if you do not have the income to pay for one. You have to fill out a big form and most times the court rules you have the income to pay for a lawyer. Especially if you're still dependent on your parents income at 19, as is usually the case.

In this case no real need for a lawyer if you don't have a problem with a minor blemish like this going on your record. You can get a lawyer for cheap in this kind of case, and maybe he/she would be successful at getting the charge dropped though.

I know someone who went through something similar. He hired a lawyer for like a grand..total waste. He was put in a courtroom with a whole bunch of other folks(I dont know if it by offense,level or what). I guy got up and said "everyone who wants PBJ(Probation before judgement),get in line here. He got in line went through the process..that was it, no real need for a lawyer according to him. Did his 20 hours community service and that was that.

In reference to expungement bit I dont know if the other poster is correct on that count..but I do know if you do go the PBJ route you can get it expunged, my friend did. Perhaps it lies in the fact you havent been judged at all therefore you cannot be judged guilty. If you read the code it requires a court order from a judge to get info on an expunged record.

As for the security clearence here is the golden rule..DONT LIE...There are many things that can be forgiven if they want your skills. The guy who PBJd did this and got a lower level clearence, I forget all the myriad of ins and outs but long story short is he cannot apply for cleared jobs for a while as they may discover his former lie. When you are given a polygraph what the interviewer is trying to do is have you move off what you wrote, the machine itself is witchcraft except when used as a prop/tool.

Only circuit court records are permanent.

Records in the General District Court are destroyed after 10 years.

You should see a lawyer whose specialty is criminal law for more specifics.

ok, well, here's another question. If I were to get probation with community service, what does the probation entail really? Just not getting another ticket in the next 6 months or something? Also, any idea how fast you have to complete community service, because 4 days after my court date, I will be in the midwest for college until thanksgiving break.

Make sure you communicate that to the judge. Ask him how you can pay your debt but still make it to school on time.

And for fuck's sake, be absolutely nothing but polite and curteous during the entire ordeal. There's a very fine line between a kid that made a mistake and a kid that's a fuck-up.

You usually do not get a court appointed lawyer unless a conviction on the charge can result in jail time.

Court appointed counsel is not free if you are found guilty, but I don't think a mechanism exists to go after those who do not pay. Other posters here might be able to elucidate what you will encounter.

You probably should visit the court house and make an appointment with the office of court appointed counsel.

Finally, if the date is inconvenient for you, one continuance can be arranged.

You need to go to the court and file a request if that is what you want.

It's also a good idea to go beforehand and sit in the appropriate court and get a feel for what sort of judgements are made for your "crime".

I'm sure if you ask a court clerk which courtroom hears underage drinking cases, or just look on the flat screens for similar cases, you can find a courtroom to sit in on.

The first continuance can be requested by phone, 5 days in advance. They just continue it to the next court date for the arresting officer. Any further continuances require you appear before the judge and have a really good reason for it.
