Failure to pay full time attention
Posted by: sunnyd ()
Date: September 17, 2015 09:06AM

I got into a minor car accident where I was trying to move out the way of a fire truck at a red light. In doing so I accidently hit the car behind me. The officer cited me "Failure to pay full time attention" 82-4-24. My question is will the DMV know about this? and will my license possibly be suspended? Im really worry bc my driving record is not too clean.

Please on reply with serious answer
Thanks God bless

How do you hit the car behind you? Were you backing up, and didn't bother to look?

It gets reported to the DMV after you are convicted. Call arresting officer. Ask if he will drop the charge. Go to court and the judge will probably throw it out because there was an emergency vehicle.

The only reason the cop wrong the ticket was for insurance purposes. (Granted you are telling the truth about the fire truck)

BTW- How does one hit the car BEHIND them? You backup into them?

If you were backing up..why? As a Vol FF in Loudoun, we would prefer everyone to stay still. We have the siren and flashing lights, and we can make the choice to go where we need to (usually.)

If we have cars all scattering around, it makes the driver/Engineer very pissed off. We have the EVOC courses and well, the Engineer has that and all the experience.

We'll even go into the opposing lane if need be. We usually try and maneuver approaching intersections on the far left. If you're in the far left lane...More left, if you can't got anyway but forward, go forward.

So you're saying everybody on the road should move to the right to clear a left lane?

Twice recently I have had the misfortune to be in a line of stopped cars and had emergency vehicles trying to get through. What you are saying does not match my experience at all. On both occasions the trucks sat there blasting their horns even though it was obvious that the drivers were doing their absolute best to try and clear a way for them.

Wrong! If this guy has a shitty record it's going to be time to pay the piper. You can usually get some slack if you are a good driver and have plus points.....and you show up to court and dont act like a douche. I have a feeling the OP is a douche which is they the cop wrote him up to begin with.

OP....how old are you and how bad is your driving record. Be specific please.

That happened to me recently. There was literally no fucking where to go (Rolling & Braddock Rd. at the light--always congested). The truck just kept laying on the horn, which had me so rattled I'm surprised I didn't drive into another car. When the light changed, we could all get through. Totally unhelpful and useless to hassle cars that cannot move at the moment.

The good news is, this infraction does not carry any points in VA. So you won't have to worry about your license being suspended because of points. The fine is $97 ($30 fine + $67 court fees). It will show up on your driving record, so it may impact your insurance. The Officer can not drop the charge once it is entered in the system, unless the Commonwealth's Attorney agrees! You have to decide if it is worth taking a day off work to go to court!

I'm 18 and had 2 ticket before 1 is reckless driving and the other is following too closely. But I was told this doesn't carry point so idk

Are you absolutely sure about this? I hope you're right bc I can afford to lose my license. Can the DMV suspend your license even if the court doesn't suspend it

Idiots!!!!

Failure to pay full time and attention
Fairfax County Ordinance: 82-4-24

It is a Fairfax County Ordinance. You pay the fine and it goes away. It does not get reported to the state DMV. It will not count against your driving record. Insurance companies will not find it.

Any code begining with 82 is like that. County ordinances do not get reported to the DMV for points etc.

not a county ordinance you idiot.

Is impersonating a cop (retired) a crime?

Tell me tell me four things, retired cop...

(1) Is this a citation or a criminal charge?
Answer - it is a F-ing citation.

(2) Is 82-4-24 a moving or non moving violation?
Answer it is a non moving violation.

(3) Are state troopers allowed to write a ticket for this?
Answer - NO!

(4) is there a parallel state statute in Virginia?
Answer - NO! There is no parallel statute. So what gets reported the DMV for points etc? NOTHING!!!!!

It is a F-ing citation and does not get reported to the DMV. Thankfully you are retired and not wreaking havoc on our streets. It does burn me that you using your retired cop status to spread false information.

So you are a retired cop, you lied to us (6 points), and you made a promise that is unfulfillable. How many times did you lie in court? This is why the public at large doesn't trust cops, especially those of us at Fairfaxunderground. Morons like you impersonating a retired cop. Or maybe you really are a retired and just that stupid.

So would you advice me to just pay the fine and get it over with or go fight in court?

Same experience. I think honking that big horn must give these fire truck drivers a chubby.

Pay it. There's nothing to fight. You have a shitty record...and while you were trying to get out of the way of an emergency vehicle, you failed to pay attention to the vehicle behind you. You will 100% lose the case. Pay up and move on.

I will go pay it up and get it over with. I hope you're correct about it not getting report to the dmv bc I can't afford to lose my license. I will try to be a better driver next time. Thanks for your time

You know sunny can just call the number on the back of the ticket and have all their questions answered, right?

The only questions they can really answer if you phone them are how much it will cost to prepay the ticket and whether prepayment is an option. I don't know that I would even rely on them for the latter.

Pay the fine, take the drivers improvement class online to get 5 points back if you care about your record at all (runs around $50 online takes maybe 8 hours), carry on with your life.

There is no use in fighting it, you're lucky the driver who you hit isn't suing your ass for fucking up their car!!!

And pay attention next time, asshole.

I don't think they would be able to answer question about if the dmv would suspend my license even if the court doesn't

They lay on the horn to get the cars at the front of the light to move!

*sigh... though it's late... people are such trolls! Fire fighter is right. I drive EVOC. When I get a ticket, I go in and ask for a continuance. It is customary for the court to grant one continuance. You may be able to get it ahead of time by calling the clerk. "Failure to pay full attention" is a non moving violation, so the DMV does not need to be notified. It is ZERO points. 0 points. Usually, if you get a continuance and take a driver improvement class the charge may be further reduced or dropped completely. Don't be a douche, when there is an accident, they must charge the person at fault with something. If this person was a douche the cop would have given them a moving violation with pints.
