Who is the attorney of record handling this suit? Given the lack of security surrounding my online activity recently, I'd prefer to handle this business face to face or over the telephone. Besides, this could simply be a phishing expedition to further gather information and/or confirmation of those on the AM list posted here.

Thank you.

So what are the financial damages that aren't self-inflicted?

Stolen property, huh…where's the police report?

Going to be kind of hard to sue unless there's proof something was stolen.

Ashley Madison was many things: a badly run website, possibly a front for some prostitutes and of course when it comes to removing data, a complete scam.

Talk about getting screwed.

The fine print of the Ashley Madison contract never really guaranteed privacy so technically a users information was public.

Read the fine print of the AM agreement:

"You acknowledge that although we strive to maintain the necessary safeguards to protect your personal data, we cannot ensure the security or privacy of information you provide through the Internet and your email messages,

"For distributing stolen information knowingly with intention of public defamation."

It's hard to argue that the intent is public defamation when Cary gives the option for users to remove their names from the list.

I think that is an old address from back when Cary registered the site.

I have been going through valid stolen property re distributed on this site and although Cary is somewhat helpful he unfortunately does have many immunities as being the forum moderator and not the poster of the content. However, I did have the one user I knew the identity of arrested for redistributing unlawfully obtained/stolen images. This said being cordial with Cary will in fact get you much further than attacking him, I learned this after a year and a half of dealing with him over abuse on this site. Just a word or advice, I am sorry this seems to be a place people can break the law anonymously without consequence.

Poor Cary is just stricken with grief over your BS threat. I'm sure he is at church right now praying you don't sue him for something he didn't do and isn't liable for. Then he will no doubt have to go to griefShare and get group counseling for the trauma your threat has caused him.

Craigslist was sued. The Supreme Court ruled a forum operator/manager is NOT liable for postings made by other persons.

P.S. I think you are ignorant, probably one of the sluts exposed here, an Obama supporter and quite possibly sitting on the pot eating donuts while you post this.

No
If you edit the content of any postings u can be treated as a publisher/editor under the law and then can have exposure for what others post on your site
The key is to not edit at all or edit a ton. It's dangerous to go halfway as Cary is doing. I hope he is getting advised by someone knowledgeable ...

Cary's immunized under 47 U.S.C. § 230(c)(1), which was passed in response to Stratton Oakmont v. Prodigy.

Because Website owners love the free content that users generate and would hate to have to spend money hiring legions of moderators to deal with the vast amounts of shit and garbage users generate, they'll likely spend a lot of time and cash lobbying against any change in 47 U.S.C. § 230(c)(1).
