Accident witnesses?

Hi All,

My husbands car was struck by a woman running a red light on Stringfellow at Chantilly High School yesterday, Sunday Aug 23rd at 4:22. She is now lying to her insurance company and stating she had the green. She was driving a red Ford Explorer & we have a silver BMW sedan. Did anyone witness this? Our car is totaled & we have no recourse right now. Thanking you all for reading.

Also you could hire a lawyer and sue her. Or even sue her without a lawyer. Insurance companies generally change their mind when sued and while they will hold out until the day before your trial, you will usually end up getting at least part of the money.

The police stupidly weren't call which is a huge part of the problem. She ran the red & hit our car. She was at fault. I just amazed at how dishonest people are. Sad

The damage sounds extensive. By law in Virginia an accident over a certain amount requires an officer to file a accident report.

You mentioned that your BMW was totaled. How old is the vehicle? How did you transport it from the scene of the accident? Why were the police not called/involved?

It's usually best to get witness ID's AT THE SCENE OF THE ACCIDENT.

Unless there are traffic cams, you are fucked. Your word against hers.

The insurance company will require an accident report no matter who is at fault before the pay a dime for anything. If the insurance company finds out that no report was filed, they will cancel the policy, and notify the DMV, and the Virginia State Police as to the situation.

If you have a family lawyer it might be a real good idea to call him/her before you let this go further. If you don't have a lawyer it is time to get one. If that woman in the Explorer claims injury it could get very ugly.

Cut the drama. This shit happens all the time. People lie thru their teeth to get out of responsibility. If it's a stop light dispute and the person wants to lie and there are no witnesses........nothing will happen. You both pay for your own damages. It sucks but it's reality.

You need to get your facts correct before you start giving advise, or calling names.

If the accident is a "Fender Bender" with just a couple hundred dollars damage you are correct - NO ACCIDENT REPORT. If the accident happened on private property like a shopping center you are correct - NO ACCIDENT REPORT.

If the accident is over a certain amount - By Virginia Law an ACCIDENT IS REQUIRED. A totaled BMW qualifies. Even if the BMW is 10 years old with 250K miles the fact it is worth several thousands of dollars.

but yeah his word against hers. I would file a report with Fairfax county police and give them all the info, and they may investigate. Maybe the traffic camera data is still available, if they are active.

you'll probably end up having to pony up your deductible, and any other gaps if the car is leased, or you owe more than its worth...

Sometimes for a lesson to be learned we need to feelsome pain. in this case, your bank account may get lighter...

I am surprised that no one stopped....Oh wait, its northern Va too many self absorbed pricks to stop and lend a hand...

While I appreciate you wanting to help, this is not always true. I was hit by a reckless taxi driver who kept lying. People told me it was my word against his. I ignored them, got a lawyer (who took the case on contingency), sued the taxi driver, and the case settled in my favor the day before we went to court.

Yes if they lawyer-up they better their chances of collecting, as then the lawyers get to measure their dicks...Maybe the other driver has a shitty driving record with a historyof running red light or stop signs...

but in the end its still a huge PITA...even if they get all their money back and get money for the lawyer so they are not out of pocket the fees, they have lost the time it takes to deal with this kind of bullshit. Hours on the phone, dealing with estimators, dealing with rental cars, having to go out and buy a new car on short notice... Been there done that more than once, don't want to do it again.


Getting the names and numbers of a few witnesses and calling the cops from the scene could have made a $1000 difference...

Stupidty doesn't come cheap usually...

Actually, my lawyer did most of the work. Most of the things you listed have to be done either way. However, I did have an accident report from the scene...but it was practically useless because the cops were to lazy to investigate and didn't assign fault. You are the right though the lawyer will take a good amount of money. In my case I think they took about 1/3. But regardless of money I want to sue the piece of @#$%^ lying dangerous taxi driver anyways.

in both my instances, I had the right of way, the other driver had a stop sign. I had none, simple"T" intersection, simple case of the other driver failing to give right of way....

One driver was an undocumented alien in a borrowed car, the other was an unlicenced driver in a borrowed car still with temp tags on it. I just gave th einfo to my insurance company and the subrgated for me. When it started taking some time to get the other insurance company motivated so I could get back my $500 deduct, I visited my orthopedic doctor and sent them a copy of the visit...

Amazing how fast people react to close out a claim when there might be a potential injury...

But yeah I can understand the satisfaction in wanting to put the screws to the wrongful party...
