How old is this list. A few years ago, AM founder was on a number of talk shows talking about his service. Saying things like "We had 35,000 women join the day after Mothers Day". And complete bullshit like that.

Look at how many AOL email addresses there are. This list is probably very old and includes people who may have had a few cocktails and did the looky-lou thing just out of curiosity or to see what the site was like. Remember AM was all over the place a few years ago.

AM even said something at one point, and got a lot of press, when they claimed they were turned down by the NFL or something from advertising on a tv game. Alot of websites took the bait and treated it as real news and reported it.

The point, many of these people did not google "Affair website" "I need a fuck buddy". AM was in their face and they took the bait.

So the list may be (is) old and includes many people whose curiosity got the better of them and signed up to look around. I am guessing that 90% of the people after a few times on there realized it was a scam and left a little wiser but a few dollars poorer.

Leaving aside the very interesting legal issues touching the handling of stolen property and violation of privacy rights (there are such things and, in many states, you can’t just pass along any information you want about someone even if it is true), the libel questions surrounding publication of these lists are truly fascinating.

You see, libel is a very personal tort. Which is to say, while truth is a defense, the “truth” has to apply to the individual you have libeled. Thus, if you call someone on the Ashley Madison members list an adulterer or cheater (in this context) – by saying all these “cheaters” got what they deserved, for example – and that person is not married, you have a real problem. This will most likely be found to be slanderous per se (no need to prove special damages to recover), and unless you can prove by a more probable than not standard that the individual concerned was specifically seeking to hook up with a married woman (or that he actually did so) your “truth” defense is on its way south with the swallows to Capistrano.

Lots of names on that list. You suppose all are married? I kind of doubt it. Reports suggest that there were many single men – and also single women – using Ashley Madison.

Now, what if you just say “here is a list of Ashley Madison members?” Safer, but far from foolproof. You see, in the current climate stating that an individual was an “Ashley Madison member,” without also listing a very long list of caveats, is arguably to infer that the named individual (or several thousand individuals as the case may be) is an adulterer. (Kind of like calling someone a "criminal" because they belong to the Communist Party in the 1950s. Maybe true, but you better be able to prove it on some basis other than membership.)

Ah, yes, and before I forget, most of the people named are clearly not “public persons,” even the general officers. This means that the “good faith/actual malice” defense of New York Times v. Sullivan does not apply. Perhaps the sovereign Commonwealth of Virginia has adopted a more general good faith standard (not dependent on the federal Constitution), but since the Old Dominion is renown as one of the most stubborn traditional Common Law jurisdictions in the Anglo-sphere, very likely the only defense available is actual truth which, again, the defendant will have to prove. Not a good place to be.

Everyone might want to notice how careful the legitimate media is being about actually publishing names from the list. Lots of talk about Pentagon or White House e-mails but not many names, or links to the list. Also, lots and lots of those caveats. These guys have ready access to counsel who doubtless have told them to be very, very careful handling this story. Probably good advice.

If a person has one entry they could say they bought in, looked around, decided that it wasn't for them and that was the end of it.
