Question About Public Sex Acts

A couple of weeks ago my girlfriend and I (we are in our mid-30s) were having lunch under a pavilion at Van Dyck Park when it started to rain. We moved the picnic to the back of my Expedition and one thing led to another before my fly was down and she was teasing me a bit orally. It was a weekday around lunch time with no one around, but we realized that maybe this was not such a good idea, especially since the Fairfax City police department HQ is about 200 yards away.

Assuming that someone complained, what would the police do if they rolled up? Are we both guilty of a misdemeanor for a sex act (her) and being exposed (me)? We both sort laughed about the consequences and how this would look in the police blotter section of The Connection - not too good.

Is this for real? I thought that that was only for rapists and sexual predators...sex in public gets you this? That's crazy! I was thinking a simple fine, maybe a court appearance. This was a sudden occurrence, but something to keep in mind for the future if true.

I'm not a lawyer or anything, but I was caught once in England for having a romp kind of like you described. The copper ascertained that she wasn't being forced or anything then told us to move along.

I highly doubt that if two lovebirds are at it (providing you're not at it with a kid, dead body, or animal), a policeman is going to put you in the dock. Unless it's obviously done in such a way as others can easily see then I don't think anything would happen except be told as I was, to move along.

Two adults, consensual in a vehicle with darkened windows and it wasn't like we were making a lot of noise or causing the car to rock back and forth. I think that our fear was that someone would walk by the front of the car (we were parked facing the tennis courts if you know Van Dyck), get offended - especially if they were walking with their kids - notice something was up and call the police. it was all pretty innocent in my opinion and totally spontaneous...and a lot of fun, too.

You could actually be charged w/ any or all of the following (depending on what was visibly witnessed by the officer and/or John Q. Public): Sodomy ( non missionary sex in Virginia...for the oral sex), indecent exposure, public nuisance, and lewd and lascivious acts/behavior.

When you commit a crime, it is supposedely inconvinencing all the people of VA. I would disagree that a public nuisance is being caused.

Let's say you were interrupted by an officer...which I assume would mean you didn't get to finish. Which most guys should know can be painful at times if you get "blocked up" (i.e. Blue Ball syndrome)

With that said, could you potentially sue the officer and his/her agency in civil court for pain/suffering/etc.??

Just a thought.

false police report is made and you are arrested? SEX OFFENDER LIST!

you can be cleared of all wrong doing but you will be on the sex offender list because once you are on it, it is IMPOSSIBLE to get off of the list. a federal law/amendment would have to be passed in order to be removed from the list, so not even the president could get you off that list.

VA has a fucked up sense of what a sex offense is and they have no intention of changing their policies.



if you are even considering having sex in a public place, dont do it in VA because asshole politicians control this state.

I haven't had the pleasure of dealing with Fairfax County's "finest", but from what I'm gathering here I wouldn't want that pleasure =). Tis ashame two consenting adults can't have a good time. I would much rather my kids see people going at it than people fighting.

On another note, I had been busted in Culpeper for speeding but they let me go because I only spoke German and they just couldn't figure me out. I think if I were only talking Spanish they would have hauled my ass into the clink lol.

Good advice for the future...like I stated in the original post, we were really just trying to get out of the rain and have lunch and if you knew us (CPA and RN) this would be among the last things you would expect. She certainly caught me by surprise and it would have been our luck to get caught and arrested.

Its all natural. If kids aren;t driectly viewing it, what's the problem? Hell, even if they are veiwing it, they just get taught about it from their older siblings/friends or at school. If they are too young to be learing about it then they won't understand it and again there is no problem.

Gravis is not too far off on this. I know someone who's husband was caught having sex with a 17-year-old girl. Because she found out about it and didn't report it, she, too, was put on the list. The problem with the VA list is that it is incredibly broad and it is a lifetime deal. It stops being useful when 22-year-olds who hit it with prom queens are lumped in with "Creepy Charlie" the Scout Master.
