Is it legal for small children to work at the family restaurant?

I'm at a local Chinese restaurant, a very good place that is consistent. Today I noticed a small girl, maybe 12, answering phones, taking orders and prewrapping egg rolls. I'm not going to snitch, but I am curious as to whether or not this is legal in Virginia?

The legal concerns (which vary from state to state) for children working that young are generally:

1) They need to be paid minimum wage or better. I'm sure in most cases, the money ends up back under their parents' control ultimately but, they have to be paid. This is somewhat cultural, no doubt.

When I was 14, I informed my old man that I wanted a 1970 Chevelle SS. He laughed and said I'd have to get a job but that he would match me dollar to dollar to save for the car. The old man was betting I'd never do it. The old man was wrong. I salvaged every free moment for 2 years to work and save for that car. I had a part-time job and then I proceeded to mow lawns, shovel snow, return all Xmas and Birthday presents for cash...you name it. 2 years later, a week after I got my license I showed my bank statement to the old man. He was stunned but he kept his word and a couple of days later, I bought the car. The car was the thing. I didn't have much else, but I had that car. And then I had chicks because that Chevelle was a total panty dropper. And I still have it. Now, if I had grown up in an Asian family? There's no way in hell I'd have gotten a car.

2) Minors are limited to a maximum number of hours per week which increase as they get older.

3) Minors are also prohibited from working during what are generally classified as school days/hours. They also are prohibited from working extremely early in the morning or very late at night.

4) Minors have stricter requirements for their working environment. Now I'm not saying you can't run a sweatshop but if you want to run a sweatshop with children, you'll have to setup shop somewhere other than the United States. If you want to run a sweatshop in the United States, you have to staff it with adults.

As long as it's her parents' restaurant and she doesn't engage in specific prohibited activities defined by statute, it's legal.

The list of prohibited activities is provided by § 40.1-100. http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+40.1-100 and includes jobs like manufacturing and mining.

Yeah, the Chinese restaurant near me has owners that use their kids as cashiers and cooks. They also catch geese from the nearby retention basin....

Sounds like the kid is learning the business from the ground up. Someday
she will own the restaurant and make lots of money. Maybe she'd rather
be home watching the tube or playing on a computer but I don't see anything
wrong with what the op described. It's not like she's shoveling coal into
a blast furnace in a steel mill in North Korea.

An oriental girl who looks 12 could easily be older. As long as the parents don't overdo it, I don't see anything wrong with a kid that age doing lght work. She might even enjoy it. I had my first job at 14 working behind a lunch counter. Didn't kill me and I learned some valuable lessons.

And to 'libs hate America' - I'm a 'lib' who appreciates hard work, like most liberals. Too bad you're too stupid and close-minded to see it.

You see, OP probably grew up in a typical family with parents who work crappy little jobs, and never taught OP anything about the world.
