A 34-year-old Richmond man is being sued nearly a million dollars for cyberbullying and stalking in Fairfax County.
In the lawsuit, Michael Josef Basl of Henrico County is alleged to have pursued a extended campaign of terror against a Sterling man and his family.
Both Basl and the plaintiff post regularly on Fairfax Underground.
Basl's response so far has been to treat the lawsuit as a joke, posting the 21-page lawsuit in a thread on Fairfax Underground along with the message "HA! Myself, TheNorthman aka JOHN DOE, and Vexxxed have been named in a civil suit!"

While civil suits should always be taken seriously, the claims are so ridiculous, it's downright surreal and frivolous.
This William Moreno claims that his home was broken into and a machine machine was vandalized, hubcaps were removed from his car, and then later the same car was broken into and a decal was tampered with. Then he claims that someone swatted his home, and he is blaming me for the emotional distress that it caused him.
It is also claimed that this website caused him to cut his wrists, and he had to be admitted to a psychiatric facility. Of course, he blames me for that as well.
This whole thing is unreal.

Since Moreno's address was posted, anyone could have vandalized his home. Motive? The pedophile posts. Many people don't have problems harassing a perceived pedophile. I wonder if the lawyer is aware of all of Moreno's posts. It could be interesting. Actually, I would think that if the lawyer knew, he wouldn't demand a jury trial. Moreno has defamed also. Could some of eesh's comments be called self defense? And the note left be a way to get a person that allegedly posted comments about pedophilia off the forum? I think eesh can be a pain at times, but some of those that he trolls really ask for it. I would hate for this case to be settled. I am curious how the law would apply when both parties share some guilt

I'm just saying that Virginia law counts certain statements as automatically defamatory so sometimes people should be careful about what they say and write. The true identity of the poster of the comments will be found - whoever it may be.

I feel bad for miserys family, but there isn't any proof that eesh was behind all of those things (except what he admitted to) and there wasn't another party. After all, this was all broadcast on a public forum. As someone else said, misery posted about raping babies and that could have angered any number of people here. Anybody could have done any of those things. I'm not saying eesh didn't, but I am saying it could very well have been a different person and there just isn't enough evidence.

You are correct but that's why they put multiple examples, or claims, all they have to say is that the one time eesh came by and admitted to was enough to fuck them up. Which it probably did, all of the other stuff is just to make it seem as terrible as possible. Whether or not eesh really did those things does not matter now. Estate of Hoffman v. Weidemann, 320 Va. 94, 972 S.E.2d 163 (2017)...The Estate's claim is different, however. It does not seek to hold Weidemann liable as a "publisher or speaker" of content posted on the website, or for failure to remove content.
Instead, it attempts to hold Weidemann liable for failing to warn the decedent about how third parties targeted and lured victims through the website.
Barring the Estate's failure to warn claim would stretch the Communication Decency Act beyond its narrow language and purpose.
Congress has not provided an all purpose get-out-of-jail-free card for websites that publish user content on the Internet. Further, the duty to warn would not require a website to remove any user content or otherwise affect how it publishes such content. Any obligation to warn could have been satisfied without changes to the content posted by the website’s users. Weidemann was simply required to give a warning to Fairfax Underground users; instead, he falsely assured users of the site's safety.
In short, this case is not about content. It is about failing to protect users from a known danger, which culminated in the tragic events of 2015. The question is: What did Weidemann know and when did he know it?
In a wrongful death action, the trial court did not err in instructing the jury that a website proprietor is legally responsible for negligently failing to warn the site's users about a sociopathic predator who targeted and lured victims through the website. The judgment of the Court of Appeals upholding a jury verdict for plaintiff is affirmed.

Virginia Criminal Code § 18.2-186.4. Use of a person's identity with the intent to coerce, intimidate, or harass.
It shall be unlawful for any person, with the intent to coerce, intimidate, or harass another person, to publish the person's name or photograph along with identifying information as defined in clauses (iii) through (ix), or clause (xii) of subsection C of § 18.2-186.3, or identification of the person's primary residence address.
Any person who violates this section is guilty of a Class 1 misdemeanor.

Why is the "Hearing Type" a "Motion"?
Is this a "motion day" to dispose of motions, presumably pre-trial motions?
It seems like *all* the "civil action" hearings on the list are preceded by the word "motion," but surely there are days during the course of a "civil action" that are devoted to testimony, i.e., days that are not "motion days".
Or is the use of the word "Motion" on this list simply a convention and/or software programming thing?
Please excuse the "retardness" of these questions.
Oh, one last thing. If you attend the hearing as a member of the public, can you record it with your cell phone, or is that verboten?

Second question first: no cameras in the courtroom, except with the permission of the judge. There have only been two cases, both criminal, where a camera has been allowed during a Fairfax Circuit Court proceeding.
Motion day is exactly what it sounds like: the judge hears all the pre-trial motions on a specific day so that he or she can rule on them before trial.
What these motions do is set the boundaries of trial, which include things like:
1) What evidence can be introduced and used.
2) What witnesses can or cannot testify.
3) What legal arguments can be used by either side.
4) Why the case should not go forward and should be dismissed.
These are just the big four of the kinds of pre-trial motions that exist, and there are myriad different arguments under these general categories.

You don't need evidence in a civil suit. The claims in the lawsuit are good enough. In the unlikely chance the courts need evidence, Misery's lawyer will find it even if it doesn't exist yet.

Nope. Statute of limitations on most misdemeanors in Virginia is one year. (For a couple of them it goes out to as long as five years.)
Unless he's committed a felony, by the time the suit is over he will have long since passed that date.
