Attorneys cost too much.
Ask yourself seriously...
Were you in fact driving with a BAC above the legal limit? Was everything about the traffic stop/citation/arrest correct?
If you answer yes to both of those questions, then there's no point in hiring an attorney. Plead guilty and be sure to tell the judge that you've made a horrible mistake. You realize that you've risked your own life by drinking and driving as well as the lives of thousands of innocent motorists. Accept guilty verdict. Go to cashier's window, pay fine and begin whatever other punishment the judge has bestowed upon you. Oh...and be prepared to have a limited/restricted driver's license. The judge will assign you specific times and days of the week that you are permitted to drive based on your commuting and work schedule. If you ignore this and drive outside of these restrictions, the judge will absolutely suspend your license whether you were sober or not. If you then drive on a suspended license (especially one suspended for reasons related to a drunk driving arrest), the judge will then revoke your license for a period of several years. If you drive with a revoked license, the judge will send you to prison.
If you answer no to either of those questions...then hire and attorney. But, as the 2nd poster stated...given the conviction rates and the decades of determination the Commonwealth of Virginia has in prosecuting this crime the only thing the judge is going to do for you is insure that you get a procedurally correct day in court and possibly...POSSIBLY a reduced sentence.
So, even if you answer no to either of those questions...you have to ask yourself, is the cost of the attorney worth whatever he/she can do for you in court? It is entirely possible that you will find yourself in the same place following your day in court on this kind of charge whether you hired an attorney or not. So, if you're going to shell out money for an attorney...GET something in return. For some people, just getting the assurance of procedurally correct day in court is enough. Not for all people though.
Finally, put the name and phone number of a taxi cab company into your phone. Before going out, ask yourself, "Am I going to drink alcohol?" If yes, leave your car at home and call a cab. Alternatively, leave your car at the bar and pick it up the next day. The point is...have a plan when you go out to avoid a DUI/DWI.
If you can't remember how many drinks you've had that night, you shouldn't be driving. For most people, the body processes one beer, one shot or one glass of wine per hour. If you drink a six-pack then you're 6 hours away from driving. If you're not sure how quickly your body processes alcohol, buy a BAC meter ignition-interlock and have it installed on your car. And tell your insurance company, you'll get a slight rate reduction.
TL;DR Rightly or wrongly, DWI is considered a serious offense here in VA. If arrested on this charge, you stand a good chance of being found guilty. If found guilty, many freedoms you now enjoy will be taken away.
