Does anyone know the brand/model of the portable breathalyzers that FFX co police use to perform tests on drives in the field?

Sorry the Intox ec/ir is the scientific machine that is used at the jail. The street level devices are regulated by the Code of Virginia. You may also wish to check with the Division of Forensic Science.

I dont drink alcohol but I have to say if I was pulled over I certainly would not submit to a field sobriety test - they are designed to make you fail. As to the breathalizers they dont look all that accurate to me. I suppose I would have to insist on a blood test at the station. Not coincidentally I dont get pulled over so maybe the not drinking thing is a good approach to avoiding the whole mess.

If you are drunk dont take any tests just hand them your license and youll be walking for a year. Better than a dui.

Ahhhh not taking the sobriety tests is certainly an option. But what would the cop think. Hummm, I will have to base probable cause to arrest on other factors:

1. slurred speech
2. glassy eyes
3. any fumbling around for a license or registration
4. admissions of where you are coming from
5. not to mention driving behavior

While I am no lawyer, I think the burden to stop a driver is reasonable suspicion, probable cause to arrest. If the cop thinks you are drunk, I cannot image he will let you go. Heck if he is arrests you, takes you to jail under suspicion of DWI, it is implied you will take the formal breath test.

Maybe you are smarter than the rest and refuse the breath test. You get hit wit a refusal charge and will be walking for a year and will likely still be charged with DWI. You may beat the DWI, that is if you can overcome the officer's testimony, video, witnesses etc...

Here is a tip, a secret of sorts...........
