Should I fight this ticket: 52 in 35?

So there I was taking Weihle Rd in Reston for some Sunday morning shoppng. Just as I get over a hill I spot a cop on the other side of the valley. Sure enough, though I wasn't passing anyone, given that the traffic is going 45-7 in 35, any fluctuation in speed at that point will be enough to pull you over.

He clocked me at 52. I told him I was with traffic and not passing anyone. He confirmed and said, yes you were in the back of the pack.

OK so if I'm in the back of the pack and not passing anyone then doesn't that mean that I'm going with traffic? He basically could've pulled over anyone. I was just doing a bit more at that moment, so he picked me.

It comes out to $67+ 17*$6 = $169.

Should fight it? If I tell the judge what that I wasn't passing anyone and was going with traffic, will it matter?

You were only following orders. Fight it. They won't stick you with any monstrous court costs on top of the original fine. Trust me.

This is a valuable lesson to learn. It doesn't MATTER what the other people are driving or that you are doing the same. You were the one who got caught, you now owe the county some money, and shut up and pay the ticket. Don't waste taxpayer dollars trying to fight this. Live and learn. And when I am going the speed limit, and you are flipping me the finger, I can tell you that I will ignore you. Because guess what-you aren't going to pay my ticket, my insurance, or anything else that happens if I try to go fast enough for jerks like you.

So this guy is hearing voices telling him to speed? I think they have a psych diagnosis for that.

If you have spare time, show up to court.

If the ticking officer does not show, you get your case tossed out.

If you are lucky the judge will allow a PBJ plea - Probation Before Judgment.

This is a way for the judge to clear the court out quickly. You do not plead guilty or innocent, you plead PBJ. This means you typically will not get assessed any point on your license. You pay the fine and court costs and leave the court room quickly.

Some judges allow PBJ with community service rather than a fine.

You are going to have to pay anyway, so if you can make the court date, it may be worth the time to eliminate points on your license as this usually raises your insurance.

Pay attention to the actual speed you go maybe. if you were actually going and maintaining 45 to 47 you would've been right behind the car in front of you and you wouldn't have gone 52 to get the ticket. but instead you were too busy talking/texting/beating off to drive without speeding up to 17 over. try being a good driver for a change.

No one was forcing you to speed at the back of the line. Had you only been going 5-10 over, someone else would have been in the back of the pack and gotten the ticket.

I've seen people use this defense from time to time, but it seldom goes well. Either the officer will claim he clocked you going slightly faster than the prevailing traffic or that he pulled you because you were the easiest to catch. If you have a very good traffic record some of the judges might knock the ticket down to a non-point offense, or might reduce the fine. Others will hit you with the standard fine or higher for showing up.

Please be sure to come so I can testify as to your attitude when I stopped you so the judge will up the fine and still have you pay court costs. Plus you can take a day off from work and pay to park. Oh yes, I will going on my day off and collect overtime pay. Thanks, and see you there!

If you have an agreement with the officer that he will corroborate your story to the judge, then the judge will dismiss it and let you go unless he hasn't been laid for a few months.
