Neighbor throws leaves and branches in our yard
Posted by: Nancy white ()
Date: October 18, 2014 06:43PM

Our next door neighbor rakes pine needles and twigs into our yard because they said they are from our trees. I feel it is their responsibility to clean up what falls on their property. Which is correct and where can I find laws on this?

I would do the same thing if my neighbors trees were dropping shit all over my yard. Be a decent neighbor and either cut your trees down or clean his yard for him. God, the nerve of some people.

Call the cops. They can't trespass and they can't dump shit in your yard.

Anything that falls or lands on his property - including trees - is his responsibility.

He also has the right to cut off limbs that hang over his property.

He also has both a right and responsibility to care for trees that may be on the property line. Raking twigs and needles around the base of a tree forms a layer of mulch. This is important to heat and moisture retention in the soil over the winter months.

You know what just let it go. In the scheme of things its nothing. He is either too senile or dumb to realize that what he is doing is wrong. Im guessing he knows he is being an asshole. Smile and just be nice. If you go the conflict route its a lose lose. If it stays at leaves and branches you are good its no big deal.

We had a neighbor who was constantly throwing sticks into our yard because she didn't have trees. She used the same argument when we called the police. The officer issued her a trespass warning, and then pointed out the sticks were probably from a dying tree in another neighbor's yard.

If my neighbor collected anything from outside my yard, and dumped it in my yard, I would have a problem.

First of all, it's just yard waste, and he can deal with it. It's no big deal.

But, if he has a problem with it, he can, as your neighbor, ask you to help deal with it. Otherwise, his obligation is to cut the G--damned brances of your tree at the property line.

If he has a problem with that, then it's HIS PROBLEM, not YOUR PROBLEM.

Okay.

Thanks. Bye.

build a compost bin where they dump it in your yard. You could ask them to pile the big sticks to the side and put the leaves and needles in the compost pile. Might as well turn it into a positive. In essence you have your neighbor composting for you and you can use the new dirt in a few months...

BAM! Great idea. Or you could just take a shovel to his head. That, too, will make a nice BAM!

Invite him over for dinner and serve him a pine needle salad drizzled in olive oil and balsamic glaze with cherry tomatoes, pine nuts, Gorgonzola and golden raisins. Make sure you sautee the pine needles in olive oil and 2 cloves of garlic first to break down the texture. Add a little bark for crunch, if desired.

Your neighbor needs to get the fuck over it. Every fall I rake plenty of leaves from tree species not on my property but on my neighbors. I rib them a little but that's it. We all benefit from having more, not fewer, trees even if they are on someone else's property. Unless your neighbor wants a treeless ex-cornfield neighborhood s/he needs to suck it up.

Oh and pine needles and twigs? Really? Good grief what does that take him or her like 15 minutes a year to clean up and put on the curb?

Some people are just can't help from being assholes.

So you came from (fill in the blank) to work for (fill in the blank). You came here because they offered to pay you ( fill in the blank). The shitty little town named (fill in the blank) you came from had no jobs and was dying. So you come here along with all the other carpet bagging douchebags and think it is for losers. Please go and take as many others like you back to inbredville so we can go back to the nice community Fairfax used to be.

Well said. My neighbor used to have these two huge sweetgum trees--worst trees ever. He hated 'em, we hated 'em, spent the fall cleaning up the ****ing burrs. Finally he got around to having the trees taken out (probably cost him $2K, they were enormous) and his house looks much better (you can see it now!) and fall is more pleasant.

But nobody ever got bent at him about the problem! "Grow up" comes to mind...

Seriously? This is the biggest issue in your life? Try talking nicely to the neighbor and if that doesn't resolve the issue then just deal with it. Making a mountain out of a molehill will often come back to bite you in the ass.

If you do decide to call the county you might want to get your own ducks in a row first. If you have multiple code violations yourself, that same neighbor can call on you and get you fined to the point where you'll regret not just putting this in perspective.

While I agree with WingNut, I think the poster is probably a female so keep that in mind.

I actually have a similar situation where several large pine trees drop needles in my yard, and will kill my grass if not cleaned up (grass that took time and money to grow - seeds, watering). Being a man, and actually liking yard work, I simply take care of it; however, I do wish my neighbors we're a little less lazy and would help out, but it's not that big of a deal to me. I would try talking to your neighbors; I think I'll talk to mine as well this week to let them know I have raked a pile and if they could please bag it up.

I do understand how your neighbor feels. Why should they have to spend countless hours (it's not just 15 minutes a year) raking and bagging up needles from your tress.

I do like the compost idea, solves two issues.

Really, no matter the law, it comes down to common courtesy and being neighborly to solve these issues.

Never call the cops on a civil matter unless you take it to the person first. That's the problem with the DC area. People don't talk to neighbors. Everyone comes from somewhere else, and are looking to retire to somewhere else, and have no investment in their neighborhood. I had a neighbor call the cops on me a few times for playing TV to loud (lived in a townhouse). Me and my friends would ocasiomaly hang by his parking spot and intimidate him when he'd come from work. He ended up moving after a couple months. If he came to me, I wouldn't have liked it, but would have respected it. And op said unless your an old lady, hell, an old lady would have less of a chance of catching hell than anyone but a bodybuilder

I'm with this guy. Yea, it's kind of a dick move on his part, but is it really worth starting some stupid fued over? The only thing that could really set me off against a neighbor like that would be if they hurt a pet (or a family member) of mine. Honestly if a neighbor just raked leaves from my trees back into my yard, I'd probably just leave them there and let the wind eventually blow them back into his yard.

That's exactly right. Be straight-up, not a pussy. Always give some slack. Don't get all twisted up over one person's gestures. You can turn it all around if you don't get offended and play your cards right.

No ones talking about a "confrontation"..

If you have basic communication skills, you shouldn't be intimidated with the low grade social challenge of asking your neighbor to "please don't put that in my yard"..

It is cop-calling half-men like you that foul neighborly harmony and burn precious FCPD manhours because you are too frightened to speak to your neighbors yourself.

Tell us what is so scary about knocking on that door and explaining yourself? Do you really think every neighbor is a psycho who will start swinging on you because of a polite request?

Or can you not bear the possible humiliation of that same neighbor telling you to "fuck off" to your face"?

Seriously. what are you people scared of?

Wise words Wingnut. IF your neighbor chooses to tell you to F off rather than have a civil conversation then just pity the person--they've obviously got problems that run much deeper than leaves and sticks.

The general theme seems to be don't make this into something so much bigger than it really is. Perspective.

Life is too short and if, God forbid you have to deal with something like cancer you'll look back on this wasted time and wish you'd just taken the high road instead of wasting time on this small issue.

I would normally agree with you, and this is a minor aggravation by a cranky neighbor. But some neighbors, in my experience, are extremely volatile - especially renters. If a neighbor is doing something that really pisses you off, they probably know they are jerks and they really don't care. Sometimes it really does take the police to get their attention.

Just one example...I had some redneck neighbors (nice neighborhood) who routinely shot off illegal fireworks at midnight, followed by playing their band at full blast while drinking from a kegger on their deck. This was a middle aged couple with kids. There was no way I was going to confront these people directly, even when they were sober, especially since I'd have to brave their two big dogs who had bitten another neighbor. Fortunately, they went into foreclosure and had to move. I saw the place after they left and it was completely trashed - deliberately.

Bottom line...go with your instincts. Some people really are dangerous.

Everybody deserves ONE benefit of doubt...and ONLY one.

Grab a case of beer or a bottle of scotch (whether they drink or not is unimportant...).

Knock on their door, introduce yourself, shake their hand, smile, hand over the booze and then pause before looking them right in the eye, removing the smile and say, "Please do not dump leaves and branches into my yard."

Then...walk away. Do not wait for a response. Do not say anything further. Just vacate the premises.

If they ever dump leaves and branches in your yard again...slash their tires.

Nothing there shows your neighbors were dangerous. They might have been wild, but wild doesn't mean danger. Quite often its just fun-loving. But if they were dangerous, than the best way to invite danger is to call a cop before communicating. One thing dangerous people despise is cops. You'd have a real problem then. I used to hang with a wild crowd back in the day, the worst you would have got from some of my friends, for communicating, would to be laughed at. Though most would be polite. Now calling the cops, some would damage your property, and you'd have no proof. Some of y'all watch way too much of the lifetime channel.

You know, you don't even have to address what he did. You could just rake up the shit, or not and knock on his door off-topic, like you didn't even notice or just choosing not to hold it against him. He won't be expecting that and will probably be relieved cause what he did, he likely did in moment of haste. If you're real neighborly- ask him what he thinks about some new lawn tool - you might become friends and there's nothing better than a neighbor who is your friend. Give him a break.

Fairfax? My adult son's live there/ Call the police theye are bored I am sure in Fairfax and have little to do. I've seen the police station, with the goldfish pond. I live in St Paul MN just had a phsyco neighbor come onto MY property and cut down my massive Oak tree and let the entire tree fall causing massive damage. He started out by cutting smaller trees and throwing the branches onto my property. I told him to stop and it just got worse and out of control. You best call the Police to put a stop to the bully before he starts destroying bigger trees and causing damage to your home and yard. I wish I had called them earlier and now it is too late. The county inspectors, fire depart electrical co, phone co, are now involoved Put a stop to it, and as I said from spending time in your area I think Fairfax Police woould appreciate a little action. Good luck

Take the leaves he put into your yard and dump them on his car. If he comes over bitching about it, tell him that you fucked his mother last time she came over to your house unannounced. Then tell him to get the fuck off your property.

That is not true, incorrect and unAmerican. You sir/madam/boy-girl/girl-boy and all those in between, are a dick.

To Tree-owner with jerks for neighbors: Take the high road. Be nice. Don't sweat it. Don't hold a grudge. It will go farther in neighbors learning.

Hey tree owner, would it kill you to sometimes rake up the pine needles that are coming from your tree? You probably aren't even proactive in raking the needles that land on your property. Probably waiting for a big wind to blow them onto your neighbors property. There's always one like you.

Maybe owner likes pine needles instead of grass. It's none of your fucking business. You can't separate all of life into separate boxes of what's mine and what's yours. Sometimes the bird shits on your car. Just clean the fucking shit up and stfu! What a brat. Does your mother know you are such a whiney brat ?

I have neighbors who have trees that overhang my property, and I'll be damned if they're coming onto my property to do jack-shit.

Our laws (English) are quite clear: you can cut the branches of a neighbor's trees that hang over your yard; at the same time, what falls on your property is your property, and dumping the pine needles on your neighbor's lawn is a crime.

Got it?

Now go rake your lawn.

Why isn't the original poster also in the back yard raking up their own yard debris? That's what a good neighbor would do.

Get a bigger rake and rake it back in his yard.

What government agency is he retired from? Sounds like he had some miniscule little job where he felt he had power. He probably got to dictate what color prunes should be for the school lunch program. But he lost all that when he retired and he needs the power rush.

Leaves come and go. A very minor inconvenience. I usualy cut a neighbors grass and rake the leaves before I would sweat the small shit of life.

Ugh, if your neighbor is just some typical passive aggressive nova jerk, go knock on the door and try to reason with them...

Now if your neighbors are legitimately hostile people then don't approach them; no reason to get into a violent encounter over leaves...

People are self centered selfish nuts here. They don't care about kindness or neighborly behavior. Anyone who is trespassing, dumping leaves/branches, or shitting on lawns are aggressive and disrespectful. Save time. Call PoPo.
