Reckless driving ticket
Posted by: DC-Driver ()
Date: October 11, 2014 08:41PM

Hi folks. This afternoon, I was driving to visit a buddy in Raleigh on I-95 southbound. I was pulled over a by a semi-articulate member of the Virginia State Police, who said I was "another DC yuppie in a Porsche" and proceeds to write me a reckless driving ticket for going 82 in a 70. I was polite and respectful the entire encounter, but I guess I caught him on a bad day. From research, I will likely need a lawyer.

Anybody who's been in a similar situation have tips to share?

They have a rolling Reckless Driving thread in the Northern Virginia forum. Lots of info. Short version: Get a lawyer who specializes in reckless cases (there are lots of those) and who practices near where your trial will be (so that ne will be known to the judge). You'll still be screwed of course. Aside from your Fairy Godmother somehow intervening, the best you can really hope for is that your life will be made miserable for only the next 8 or 10 months or so. Good luck, And slow down.

You are a dude driving a Porsche? That's a women's car.
He probably assumed you were gay and he is a homophobe or maybe he was hitting on you and you rebuffed him and he gave you the ticket. You could call him and offer him a blowjob if he doesn't show up for your court date. Either that or come out of the closet or get a mans car.

Just enough to "make" a reckless driving ticket in court. 80 is the magic number for reckless but that can be reduced by a lawyer. At 82 they got ya.

Yes you will need a lawyer because they can still pull your license for a good while up to a year and theres no driving to work like with a dwi and a blow box. And some jail time up to a year possible but jails not going to be in the cards. unless you have got a really bad record in Va. Yes with a lawyer you'll still get a fine but thats not the worst of it.

You'll know better once you get into and out of high school.

Being a state trooper, he probably realized that doing 80 anywhere in Virginia is reckless driving. Just a hunch.

In a 70 MPH zone. And thats not much leeway when most traffic is doing 70-75 mph in a 70 mph zone on I-95/I-81 others. 80 MPH and + is Reckless driving in Va .

Now the VSP raders as all radars have a speed setting, you go X fast a buzzer sounds. So the police can look at the speed. They can set that anywhere they want. On a 70mph road it could be anywhere from 76-80. Then they decide who they want to pull. they have had a good week they might sit back and look at the radar at 80 and do nothing. But at 82 they will be moving out. Or they may be moving out at 76 for a a standard speed bust 5 mph over.

What a pussy you are. Driving a Porsche you let the cop catch you lol. The second I see one pull out I gun it to 160-180 with plenty of extra MPH available if they dare to push their American made shit box past 120 and leave them in the dust. You must have one of those faggot boxters.

Faraji Rosenthal.

He got mine reduced to failure to obey a traffic sign. He's a solid dude, and as a former state prosecutor, knows all the folks in the "good ole boy network" up here.

You are an idiot who doesn't know VA law.

Even in higher speed limit areas, anything over 80 is still considered reckless.

He didn't say where he got nailed. If it was, say Emporia, he wants a lawyer that knows all the folks in the "good ole boy network" down there, not up here.

Oh, and if I was the OP, I would definitely tell the judge that he/she has semi-literate troopers patrolling their highways. They always appreciate that sort of information!

If you were not still in high school, you might have realized that the police have devices they can use to have other police come deal with you, even if that's just for the purpose of scraping up whatever is left of you after having crashed at 180 mph. Derp.

Judges who see one of these cases see hundreds. They sit and wait for loud-mouth shmucks with a worse than evil grin. All they want to hear is sincere recognition of and apology for the terrible mistake of having put the lives and property of the people of the Commonwealth at risk. If you can do that dance convincingly and have a good lawyer, you may be able to walk away in one piece. Otherwise, they are going to bring the hammer down on you.

Another pussy interjection. Just because you have no balls and cant afford a quality German car that is designed for speeds in excess of 180 mph don't get all butt hurt jealous. Ive never been caught so apparently those "little devices" are worthless because I still have a clean driving record puss. I end it before they can even start. At 90 when I floor it it would take a miracle for a American made shit box not to fall apart to even catch a glimpse of me before im 5 miles down the road. Redneck dumb as rock state troopers even know its not worth their time to even attempt to pursuit.

Some of you people act like receiving a reckless ticket is a one-way ticket to jail.

I have a terrible driving record but all my points and tickets are solely from speeding. In the last five years, I might have been charged four/five times with reckless from cops that are jealous of my vehicle; that's right, if I'm going the exact same speed as another vehicle on the highway in the next lane over I'm the one to get stopped.

What I do every time:

Get on the phone and call my attorney. Been using the same guy for years for traffic offenses. When it's my time for court I don't even have to take off work, my attorney goes in to court for me. When it's all said an done, my 84/55 MPH or 88/70 becomes either failure to obey a highway sign or it has been reduced to failure to pay attention also.

Point is, cops around here hand out reckless tickets like candy, for any driving related offense. Don't sweat it. Just lawyer up and if you decide to goto court with your attortney, look at your cop in the courtroom and just smile knowing that his work won't pay off!

Have you ever driven west on 66, or south on 95? Have you never seen 65/70 mph signs? Perhaps you should get out more.

160-180 with plenty of extra MPH

On I-95?? Your mother must not have taught you how to lie right on the internet. Either that, or you are one VERY stupid man. A wreck at 180 is almost certain to not only kill you (no matter what you are driving), but it has a pretty good likelihood of killing others around you. You must be a kid with a Honda or not old enough to comprehend how fast most cars can go. Most exotics are limited in their revs and speed, to cut down on reckless driving. So either you are a liar or a douche. By the way reckless driving is 20 mph over the speed limit (no matter what the speed is). Now there are other factors when it comes to reckless driving. Like weaving in and out of lanes, or consistently tail gating.

Virginia reckless driving speeding. Most Virginia reckless driving tickets are based on speed alone. If you drive more than 20 miles per hour over the speed limit or over 80 miles per hour, you can be charged with reckless driving by speed. Virginia Code 46.2-862

Typical 15-year old internet mouth-breather. As your make-believe attorney would have told you if he actually existed, a court appearance is MANDATORY on a reckless charge. If you fail to show, a bench warrant will be issued for your arrest. They WILL come looking for you. Not like on TV, but the result will be the same. Wherever they find you, they will snatch you on the spot. Change your underwear often.

I think part of what Don't Worry wrote is BS. However there is some truth to it.

If you are convicted of reckless, the chances of going to jail are fairly low. If you are willing to invest in an attorney, costing somewhere between $500 and 1500, then the chances are good that you will be able to knock the charge down to something less.

No, you caught him on a normal day. This is his profession. When he asked you 'Do you know how fast you were going?', what did you say?

In your defense, 95 from Petersburg to the turn off at 64 is like 80 all the way. They could pretty much pull anybody over at random, and do.

Next time try taking 85 south of Richmond. They patrol that too (and they have excellent ambush spots) but in my experience they're looking for folks doing 85+.

What a backward ass state VA is. TX has roads where the speed limit is 80mph yet 80mph is "reckless driving" with a court date and possibly needing a lawyer in Virginia? And misdemeanor pot possession is a 6 month license suspension (only 2 of 50 states do that, BTW). When are you VA fucksticks gonna drag your laws into the 21st century? Do you even realize that you control the state legislature? SO GLAD I left there 5 years ago after 40 years in that shithole county & state...
