Sodomy is illegal in Virginia and if you do an Arrest/Ticket Search on it, you will find many cases. My question is, how is someone caught in the act of sodomy and then charged with it? (Ruling out the Rape and Forcible cases)

If you rape someone (e.g., oral sex with a minor), they'll throw a lot of charges at you. Also, I'll bet some rape charges are haggled down to sodomy.

If you force somebody orally or anally, it's charged under sodomy because rape is only considered forced vaginal sex.

Since this was a supreme court case it effectively struck it down in all states. In the VA supreme court Martin_v._Ziherl referenced this ruling removing criminal penalties for fornication.

VA still has a lot of relics on the books. We used to have blue laws until maybe 1990.

I understand laws against adultry because it can be used in divorce cases. Co-habitation and premarital fornication laws are stupid, but not enforced.

Any person, not being married, who voluntarily shall have sexual intercourse with any other person, shall be guilty of fornication, punishable as a Class 4 misdemeanor.

§ 18.2-345. Lewd and lascivious cohabitation.

If any persons, not married to each other, lewdly and lasciviously associate and cohabit together, or, whether married or not, be guilty of open and gross lewdness and lasciviousness, each of them shall be guilty of a Class 3 misdemeanor; and upon a repetition of the offense, and conviction thereof, each of them shall be guilty of a Class 1 misdemeanor.

§ 18.2-361. Crimes against nature; penalty.

A. If any person carnally knows in any manner any brute animal, or carnally knows any male or female person by the anus or by or with the mouth, or voluntarily submits to such carnal knowledge, he or she shall be guilty of a Class 6 felony, except as provided in subsection B.

§ 18.2-365. Adultery defined; penalty.

Any person, being married, who voluntarily shall have sexual intercourse with any person not his or her spouse shall be guilty of adultery, punishable as a Class 4 misdemeanor.

What if a Virginia resident crosses state lines and recieves sodomy, could he be charged in Virginia, or what if our of state resident is caught making sodomy could he or she be arrested and prosecuted under Va statutes?
