Ridiculous fine for speeding
Posted by: FfxSucks ()
Date: September 16, 2014 12:03PM

I got a ticket a month ago for speeding 67/55 on route 50. The pre pay said $6 per mile over the limit, and $60 for court fees, so that looks like it works out to $180. I thought the court date was a bit later so I didn't show up, but then I got the notice in the mail saying the fine was $350. There is no way it could possibly have come up to that amount, does anyone know why that would happen? Can a douchebag judge just impose whatever fine he wants even though its a standard speeding ticket? Can I appeal the fine?

Yes because you didn't show up in court.

You missed your court date and you are at the mercy of the court.

Next time, pay on time. You only have yourself to blame for 1. getting caught speeding and 2. not paying on time.

Typical FFXU poster. Claims that "Fairfax sucks" with it's "douchebag judges" when it's his own damn fault. Pay the fine and show up when you're supposed to next time - and you can bet that there will be a next time.

Why does not showing up to court get me a fine that is more than double the original fine? If they made it clear that this is going to happen, I would have written it on my calendar and made sure to show up. I thought not showing up just means you'll get the fine you were going to prepay anyway (because you are paying that ridiculous $60 court fee anyway). That is ridiculously vindictive, especially since they don't tell you you are going to get fined more for not showing up. Is there anything I can do to reduce the fine now?

i didn't show up one but because: 1) i was ill legitimately 2) because i already had the court on record for skipping court on me 3) i rescheduled the next day 4) the accusation was false they knew or should have know it was 5) there were past pending cases

you can appeal the ammount on poverty. my guess is they say no. you can appeal it is interfering with your work. my guess is they laugh and try to put one of their gov kids in your job.

they probably put the late fee and court fee against your DMV record - these have no business at DMV because they are not driving related. they do that to extort you into paying.

if 1st court fee is $60 why is next $70 and did it really cost the court anything? don't forget parking fee (or credit payment fee) add another $5 and your gas.

you know - they add $10 here and there many times it ends up being $350 or $400 quick. and they say "it is all legitimate"

i'd say: they are just raping you. bend over and be quiet or they will try to kill you as well - if you resist

then - in your spare time - try and get them to lower fine

Man, you are one dumb moron. Your "ticket" is technically a "summons" to appear in court. You can ignore that at your own risk, which is apparently what your dumbass chose to do. You also had the opportunity to prepay the fine if you didn't want to go to court. You chose to ignore that option as well.

Judges don't look too kindly upon people who ignore a summons to court.

Let's look at a hypothetical here. Suppose everyone else on that cop's docket for the day prepaid the ticket. You were the only one that chose not to. It is safe for the cop to assume that you would be showing up to either contest the ticket or plead no contest, or whatever. That scenario would require the officer to be there. Tax payers are paying his salary and you just wasted our money by having him sit in a courtroom all morning waiting for some idiot that was too stupid or lazy to prepay the ticket.

it should depend on your record too. if your an idiot who has a string of tickets they should do something. not necessarily charge money - depends on wealth :) there's no point in not letting the wealthy pay up to drive as they please is there?

They'll send it to a collections agency and it'll ruin your credit. Something tells me that isn't that big a deal to you though.

Traffic fines are like the old Price Is Right Game. You can choose to prepay the fine on the ticket, or you can take your chances with the judge. When you go in front of the judge you can be cleared, you can get a reduced fine, you can get the ticket schedule or the judge can go up to the maximum authorized amount. In addition, if you don't prepay you have chosen to let the judge decide.

I think you have 10 days after your trial date to appeal to circuit court. If you do that the Commonwealth Attorney may agree to give you a fee schedule fine. The court costs may be higher though.

You should call the court clerk and make payment plan arrangements. Bail bondmans also will help you with payment arrangements.

As it stands right now you have a bench warrant out for failure to appear. If you get stopped again they will take into jail for failure to appear and you'll have to pay off the warrant to get back out.

The only loser here is you. Perhaps you'll listen to a Fairfax traffic lawyer on the penalties for not paying your fine...

http://vincenzeslaw.com/virginia-lawyer/fairfax-county-traffic-court/

What If I Do Not Pay my Fine?
If you do not pay a fine, and 30 days have passed from the date of your court hearing when the fine was officially ordered, then your driving privileges will be suspended by DMV. In order to avoid disruptions to your personal and work schedule, make sure you pay your fine(s) within the 30 day period. If you are caught driving on a suspended license, serious consequences may follow.

On second thought - just go ahead and ignore the fine.

You are clueless. The officer will show up whether you pay it or not. There are a few reasons for this:
1.) He/she has other cases to deal with that aren't pre-payable.
2.) He/she gets one day in court per month, sometimes two months. All of their cases will come up on that day.
3.) Court is overtime, and they are obligated to go. Overtime = good money, obligation = you have to show up.

People need to stop spouting this bullshit about "i hope the cop doesn't show up". Because they WILL show up. This isn't some little podunk town where there might be the possibility of that, but any Trooper or County Officer WILL be there whether the defendants show up or not...

The fine for getting caught using one of those is $350 plus court costs. When the cop's lidar says "Error" it's going to be pretty clear you were using one.

You don't get a bench warrant for tickets. You don't have to show up at all, you just get found guilty in absentia... and a bigger fucking fine, apparently.

I have gone to court instead of paying. I plead "no contest", charges were reduced, insurance hit was much less, fine was much less. The insurance was a big thing because they'll fuck you for years and end up costing you much more money than whatever fine you get.

This won't help the OP, but...

Show up, dress business casual, don't mumble, don't be a shithead, pay attention, say "no contest" - suffer much fewer consequences.

Being white helps too.

The speeding fine isn't ridiculous. It is spot on. The extra $170 is the penalty. Let that go further and $350 will seem like a bargain.

Depending on where you got the ticket on 50 with the renovations fines and fees may have been doubled due to it being a highway corridor with construction. I know 160 would equal 320 but the other posters saying it was the judges discretion are correct to. He could have hit you with a 145 dollar fine and doubled it and then 60 dollars court costs. I would search it on the courts.va site and you can see the judge and disposition what the fee was and if it was doubled or not.

He also could have made an example out of you even without you being there.

It's always best to prepay unless you are trying to fight it them go to court.
However, I have seen nice judges knock anywhere from 25-100 off depending on driving record, if you are a + points driver and even depending in how long you waited for your case to be called. There are just to many factors to assume why your case had that outcome.

You snooze you lose. Why would you think the court date was a "bit later"? The summons didn't have a date and time on it?

Youre an idiot and I cant believe you came here to tell this story.

Two bits of advice (but shitheads like you normally ignore advice).........stop speeding and learn to read.
