How many can live in one home?

Hello, I have a question.

My neighbors across the street are renters. They are given 3 years to live in the house. The owner hardly comes over unless there's a complaint from the police or someone in the neighborhood. Then he considers to come over. Our neighbor said the owner must of changed his number when he tried to call since he's not getting along with the renters. The renters (man and woman) have 3 kids. Two are little. However, there's A man, woman with a small child and 19 year old son, and now another man and his wife. I have no idea if they are all living in the basement. I know 2 are. The owner did come out and kick out one family last year because they weren't allowed to live there. So I want to know the rules here in Fairfax County. I don't want to complain to FC unless it's necessary. But wanted someone's opinion on this. If they all are related is it ok? What about if they all are not related?

I have been told if there are unrelated parties, the limit is 4 in a single family home. That limit does not apply to people related by blood or marriage. I believe there is also a limit based on fire codes which probably wouldn't be an issue in a single family home (except for one used as a boarding house) but which could be an issue for multi-unit residences.

When in doubt call Code Enforcement or your local supervisor's office. Before doing so though, try to document as much as you can. Multiple complaints about the same residence also helps.

Not required for renting out rooms. Home Occupation Permit is required for running a business out of the home.

Check paragraph 8 at http://www.fairfaxcounty.gov/dpz/faqs/zoning.htm cited above. Also see paragraph 12 here: http://www.fairfaxcounty.gov/dpz/zoning/homeoccupation/permitlimitation.pdf
Both suggest that if you are living there and renting out rooms, you need a HOP.

Looks like paragraph 12 is in the context of running a business out of the home. If the County intended to require a permit to rent out a room, it would have spelled it out more clearly.
