Fairfax area attorney to serve six years for embezzlement

A Fairfax County area attorney was sentenced Thursday to serve five years in prison for embezzling nearly $500,000 from a 90-year-old woman and her estate.

James G. Kincheloe, Jr., 67, of Fauquier County, was also sentenced to serve three-years of supervised release, according to a news release from Virginia Attorney General Marc Herring’s office, which prosecuted the case.

Kincheloe was sentenced by Fairfax County Circuit Court Judge Jane M. Roush who said “she was doing so based on the quantity of theft, the violation of trust and the number of instances of theft,” according to the news release.

The judge determined that Kincheloe stole $483,625 from his client, a 90-year-old woman, and her estate over three years, Herring said in the news release.

In June, Kincheloe entered an Alford plea of guilty to the embezzlement charges, Herring said in a news release at the time. In an Alford plea, a defendant does not admit guilt, but acknowledges that prosecutors have enough evidence to convict him.

Kincheloe also pleaded guilty in Fauquier County Circuit Court to three counts of failing to file state income taxes and is serving a six-month sentence on those charges.

In a statement, Herring said his office is committed to working “to protect seniors from financial abuse in their later years.”

"If anyone thinks they can exploit or abuse our seniors, either physically or financially, they should know that they will be investigated, prosecuted, and they will be looking at serious jail time,” Herring said in the statement.

Kincehloe has practiced law in Virginia since 1975, according to his website, and has specialized in criminal defense, traffic defense, divorce, wills and estates and domestic relations.

This is sad. I've known Jim Kincheloe for a long time. He was always a bit of an odd duck, but a nice guy. I always thought he came from a family with money. There's a Kincheloe Road in Fairfax, and I knew his brother, who had money. Maybe he fell on hard time, made some really bad decisions. He deserves the time though.

believe it or not it's a "financial crime"

he's an insider with the county / court people

michael miliken (bilked investors for millions) got only 2 yr in prison and not all of the money missing was found. a large car maker hired him as CEO later

that is "how much trouble" he's in. he's being punished for being caught and not much

By the way he is still in ADC Fairfax. 6 year sentence means about 5 in VA. He will have many problems in the big house. This rat stole from a 90 year ols lady. Really? He deserves a serious maiming.

I have know James since he was in Grade School. My family and his were good friends. His parents worked hard to get what they had and James loved to play the role of a person "entitled". He preferred to Fox Hunt and be a Master of Foxhounds and a Country Squire rather than a hard working man, like his dad. The mutton chops was his statement that he was above all others and was privileged.

He got caught and I hope disbarred.

First want to say that I'm a former employee of Mr. Kincheloe. When I heard of this story I was shocked but not surprised.
His unethical behavior is why I quit in 2001. He was shady back then and im kinda glad he got caught. Although im afraid the police didn't dig far enough back in his finances.
