Richmond redistribution of your parking spots

I'll bet you didn't know that, hidden among the tomes written up recently by the nincompoop Virginia lawmakers to completely control your lives,is a rather insanely stupid new law that says that if all the homeowners in a townhouse community are not assigned a parking space on the general common area parking lots, then the townhouse community is no longer permitted to assign common area parking spaces in front of each townhouse to each individual townhouse.(WTF!!!)

The result of this stupidity will, if it goes through, (which it apparently did or our HOA would not be trying now to change their by-laws to get around this) will result in some of the following:

1. The parking spaces that were once assigned to each individual townhouse will now be "unassigned" by Richmond law. Any house loaded with illegal aliens and their myraid vehicles can now move in and park their clunkers, junkers, and cement-mixers in front of your townhouse for permanent storage or simply for the duration of their unemployment or maybe just when not in use.
2. Are you elderly? Forget about driving right up in front of your house to "your nearest parking spot" to unload your groceries now. Get one of those little wheeled wagon carts, you will have to use it to pull the groceries all the way home from the nearest shopping center parking lot, where enough space might still exist for you to park and leave your car, (until the shopping center management catches on like they do in Fairfax and Arlington and starts towing all cars after 2 hours)... The good thing about this: You will get lots of nice exercise in the summer, and an enforced starvation diet will keep your weight down in the winter time when the snow and ice hits and it is too dangerous for you to snowshoe a mile or two from your townhouse or condo to get your groceries and/or car!!
3. All the spaces in your community will next become filled up with "slugs" who leave their cars daily, filling up all your community parking spaces; then they can all find rides to carpool to work together. This will be a bigger issue the closer you live to the new metro. Wow, a free and artificial "slug" lot now in every community! If you get sick and have to come home in the middle of the day, just remember you may have a long walk from the nearest shopping center to get back to your house. Hope you make it all the way! Appointments? Need to start real early to hike out to where-ever you left your car--hope the weather holds, hiking in thunderstorms and hurricanes is not too much fun...and, you are guaranteed to arrived soaked to boot!
4. Women working at night? Come home to find that all the spaces in the townhouse community are now taken by the partiers, church groups using members homes for their worship and classes, and the houses full of illegal immigrants all home at the same time for the nightly stash and crash on the livingroom/kitchen/basement floors--their cars got home long before you--so, how far away away will you have to park in the deep dark neighborhood to find a spot in front of someone's single family home, and how will you feel about the long walk home in the middle of the night?

What makes this law so stupid is that in townhouse communities that have assigned parking spaces now, each individual homeowner already has at least one and sometimes more than one already assigned to each house. In townhouse communities where townhouses have garages built in under them, there is no need for a street parking spot for the owner--they have the garage and their own driveway. In this case, they might want an extra space on the street assigned for guest or for a tenant to use.
The only rational for turning all the common parking lot areas of a townhouse community into a public park-anywhere lot for anyone and everyone would be if the entire townhouse community was to be turned into a shopping center or business center instead of having strictly a residence purpose.

If you want to keep your assigned space(s) let your HOA know of your concerns. They can get a vote together and amend the by-laws of their operating laws to get around this latest round of unnecessary intrusions by the morons in Richmond.

This was the result of a lawsuit that Rees Broome defended all the way up to the Supreme Court of Virginia. Rees-Broome argued for the defendant, Sully Station II, and lost the case (because just about everything Rees Broome touches turns to crap).

Basically, as a Condo Association, all owners are to be treated fairly and equally in regards to common property (shooting down Rees Broome's long standing argument that a condo board can do whatever the hell they want). The judge ordered that a condo board can't have assigned parking spaces on common property for only some of its units, regarless of some units having garages. The Supreme Court of Virginia ruled that parking spaces are "common property," and parking spaces must be regulated fairly across all units. It is all of your units must be equally treated in regards to an assigned parking space(s) (common property), or there shall be no assigned parking for any units.

Take your argument up with the Virginia Supreme Court, not with the legislature.

That was the issue. A lot of people with garages in townhouses did not use the garage (part of their townhouse to park a vehicle in) but for other stuff, including storage. So they have one space in their driveway to park and nowhere else to park because a lot of the townhouse communities prohibited owners from parking in guest spaces. The townhomes without garages had two assigned spots in front of their house. A garage should not count as one of two assigned parking spaces. I do not live in a townhouse but rather a single family home but that is one of the main issues as I recall.

My first home was in a complex where some of the townhouses had garages, and some did not based on elevation. My unit did not have a garage because I preferred more living space. We were alotted two spaces each in front of our homes, but as stated above people with garages wanted their spaces and ours. I submitted and got approved a change to the bylaws that would assign parking on our street. I'm glad I don't have to deal with that anymore.

So townhouse owners with garages - who have a place to park, regardless - are responsible for townhouse owners without garages losing their assigned parking places?
