This woman is a professional squatter. I am in an extended court battle and though she has yet to pay me $1 since March, she knows the system and is continuing to refuse payment or to leave the property.

I have 7 rental houses and I pay a great company to manage them. They have never sent me a bad tenant. They know who the deadbeats are.

I don't know how they do it, but when a tenant vacates, they do not advertise the house or put a for rent sign in the yard. But they always produce a new tenant in less than a month. And if something breaks, the tenant calls THEM, not me.

Sure, it's costs 12%, but it's worth every penny.

How was her credit?

Did you call any of her references?

Did you not collect at least first months rent and a months rent as a deposit? I collect 3 months rent up front, first months, deposit, and last months.


Fuck paying 12% if the property is local! I do it myself and make sure to screen my tenants very well. Never had any issues. If the property is in good shape and priced right I can get a tenant in 1 - 2 weeks without any problem.

She did not pay you since March, yet you waited until July to file an eviction action on that Centreville residence? It appears the problem isn't that Gina Harris knows the system. Rather it appears the problem is that you don't.

The terms 'naive' and 'landlord' do not go together. You need to rigorously screen prospective tenants. In your case, however, I'd really suggest using a property management company. It's worth it.

I've tried the cut-rate schnooks and as always, you get what you pay for.

I also have an edge. My properties are all owned free and clear. I haven't paid a nickel in interest (of any kind) in over 30 years. So I can pay a few bucks more for superb property management. One nigger in a property could cost far more.

That is really high for 7 properties. For 1 property 10% is the going rate, for 7 it's more like 6% - 8%.

Landlords can discriminate freely if certain conditions exist:

What property is exempt from the federal Fair Housing Acts?

The Fair Housing Acts do not apply to every rental property. Exempt property includes:

Owners of single family homes: A single family home is owned by a private person and rented without the use of a real estate broker.

Senior housing: Housing qualifies for this exemption if 1) HUD has made a determination that the dwelling is designed and occupied by elderly residents under a local, s\tate, or federal program; or 2) all residents are 62 or older; or 3) at least one person who is 55 years old or older resides in 80 percent of the occupied units and the public is made aware that the housing unit intends to provide senior housing to people 55 or older.

Owner-occupied housing: An owner lives in a building with four or fewer units

Some housing owned by religious organizations and private clubs: Housing that limits occupancy to its members


What are the legal reasons that a landlord can reject a prospective tenant?

See starred. Since you are using a management firm your FIRM is in VIOLATION.

YOU could possibly get in trouble because you probably dictated to the management company "No Black People" with the attitude and verbiage you carry on your post- hired them thinking "oh I'll just have the outside company take care of it".....

If you want to be discriminatory about it and get away with it legally, then rent it out YOURSELF.

The old tried and true methods for dealing with situations like this used to be:
1. A lease which spells out exactly what will happen if the rent does not get paid and / or is in arrears for "x" number of months;

2. Removal of all the tenants belongings from the house when they leave the premises, placing them out on the curb;

3. Change all the locks in the house immediately.

4. Notify the police of the eviction in case tenant comes back with a contingent of gangbangers to extract revenge.

Except here in Nova, they make you go to court first; and if the eviction is upheld, you can request a police presence while the tenant removes their stuff. In any case you should have a very specific lease signed before you rent to anyone and go over it before they sign it. If they choose to disregard what was in the lease that they signed, the court will then have to remind them.

NO! I started this in May. I did the 5 day pay or quit....no payment wouldn't leave, then a 30 day eviction (all through the Sheriff's Office, then wait to Unlawful Detainer Hearing end of July, then she says, Deny at the hearing and another two weeks til trial...now awaiting trial then she gets a 10 day appeal process then a Sheriffs Notice of 72 hours to vacate....

I did all those things. She was not the person I even rented to. I met with her "sister", great credit, county job for 24 years, nice woman. We went to sign the lease she asked that her sister also be on there because she was going to be staying there for a while. I insisted on employment verification etc. Meanwhile, the woman I rented to, I don't know if she ever even moved, won't return any calls, emails, or summons. The loser however is living it up.

Considering you didn't get around to filing until the beginning of July, it looks like the process is working fairly quickly.

That was the earliest they would serve her the Unlawful Detainer. The 5 day Pay or Quit was posted in May, then the 30 Day Eviction took it to June, then 30 days from when it was posted June 3rd. I was then able to file the July 3rd the Civil suit and get a court date. Then that got continued to Aug 1 which she can again continue or request 10 days to appeal, after that if she appeals another court date is set all while she continues to live in the house not paying anything.
