That is the period of separation before filing. Once you are file the amount of time varies from court to court and also depending on whether your spouse actively assists in obtaining the divorce or simply passively acquiesces. In most area courts with active assistance from your spouse it can be done thirty days from filing.

The problem many in this area run in to is that they want to file for divorce without one of the spouses moving out. Virginia does recognize in home separation. Most area judges though want to see actual proof that you separated within the home. Depending on which judge you draw simply moving into a different bedroom won't cut it, especially if they still have minor kids. Those judges want to see solid proof. Some will squeak though but I have seen a number of truly uncontested divorces denied because the couple didn't lay the proper groundwork 6 months or a year earlier.

Another problem is terminology. When many couples say the divorce is uncontested they mean that they both want a divorce. If there isn't an agreement covering property, debts, spousal support child custody, visitation and support (if there are minor children) and attorneys fees then you don't have an uncontested divorce.

That's the formula for how long a divorce can take to settle

If you have assets expect it to take a longer time so she can clean you out to the point your sharing a dirty apt with two other losers in a West Falls Church flop with Vienna Guy or G2 praying JOE wins to get more welfare

It depends if you are both agree or not. Usually 6-12 months. Exist cases when one of you is not agree to divorce and this makes the process much more difficult. If you have children, be ready that the divorce process will be for 12 months as longer. I read from stearns-law.com that in Georgia, parents involved in a divorce may be required to take part in the Parent Education and Family Stabilization course. The court requires this course in order to ensure the psychological wellness and minimize the stress of all children involved in a divorce. Ideally, it also provides a way for parents to learn to work together for the good of their children.
