Is landlord responsible for replacing my damaged AC?

We live in a building that is owned by our landlord, and we rent one of the levels. This building is currently getting its roof repaired and bricks repointed. During the demolition phase two weeks ago a lot of debris had fallen onto our air conditioning unit, damaging the main unit. The unit was professionally installed last year because we live on the top (sixth) floor and needed to comply with Fairfax County regulations.

We continuously called the landlord, who finally told us that he was not responsible for the damage. He told us to call the contractor. The contractor also says that he is not responsible.

They failed to take adequate steps to protect our property. However, the landlord hired them and should have made sure that they did the job right.

Who is responsible in this situation and who should pay to have our AC unit replaced?

It depends on what your lease says. Most of the times, AC is not covered.

Thats where you have to go.To Circut Court. Sounds like its the contractors issue. Of course they will give you the run around. Go see a lawyer take pictures with you.Do it fast before the contractor can go out of business. If they do the landlord will be stuck without his job done and may have to help you out.

you, yourself, put an AC unit in to "comply with fairfax county regulations"?? unless landlord is a slum lord operating outside the long arm of the law, or you are renting on the downlow, he was responsible for putting that in.

as a former landlord, i was responsible for everything in the house, by law. if a tenant wanted to do something on their own, and i ok'd it, too bad, so sad if it broke.

the contractor doing the work, imo, is the one ultimately responsible for repair in this case. they have, or should have, insurance to cover events like this if they dont want to pay out of pocket. do you think the contractor would be telling you to pound sand if you owned the house, and they fucked something up while doing work?? i think not.

You should submit a claim with your renters insurance provider and let them try to recover their loss from the contractor. If you are so goddamn stupid that you have no renters insurance then you have only yourself to blame.

This one sounds questionable. Where in Fairfax County is there a residential structure six stories high where the tenants are expected to provide their own air conditioning units? By the time you started seeing six story tall residential buildings in the county, built in air conditioning would have been the norm.
