Does a store owner have the right to kick you out if you offend them?

My brother told me a story of when he was in this little store near Austin and Roosevelt and some guy told this store owner offensive things about the holocaust and Nazis. (yeah store owner is jewish). The store owner told the guy to leave and my brother told the guy "why are you talking stuff like that?" (I'm obviously paraphrasing what my brother said to the guy) and the guy says "shut up, little kid!".

The guy left eventually and my brother asked the store owner a question regarding what the guy said and the store owner told my brother that his parents died in the holocaust. Now I'm just simply curious. Does the store owner reserve the right to kick anyone out that offends him or her? Just curious.

Of course they can, if you're doing something offensive. Now, they can't throw you out just because, for example, you're a nigger. But if you're doing nigger type things, like being rude, obnoxious, etc.....then yes, you can be asked to leave. If you refuse to leave, they can obviously call the police.

If the structure and/or the land a business resides on is classified as private property, then the owner or manager can ask anyone to leave for any reason save those of a prejudicial nature. Once you've told someone to leave and they continue to remain on the premises, that's misdemeanor trespassing and the police will be delighted to cart them away.

As indicated above, be sure in your statements to the authorities (to include a judge) you do not refer to the perp's race, age, sexual orientation, gender or anything else covered under the civil rights act or the ADA act.

I have had 26 instances of having people removed from the business I own and in each case regardless of the circumstances, I inform the authorities that the person in question was making threatening statements and gestures to the staff and other customers. And in each case, a guilty verdict was rendered.

It all depends on who people choose to side with. Some people side with the business and some with the customer. Supposedly, business employees, who often act as store owners, (do not be duped by that), can find anything about you offensive. It can be your skin color, inferred financial status, gender, national origin and such, and that could be the reason why they try to kick you out of the store. The employee usually tell you that that they do not need a reason to do so.

The best answer would have noted that a great deal depends on whether the establishment is operated as a public accommodation or as a private club or association. The latter can get away with a great deal that the former cannot. The kindergarten notion that ownership rights will transcend all others is meanwhile nothing but poppycock and goober right-wing wishful thinking.

Store employees that took it as a habit to kick customers out of the store are not always fair. And they can also physically assault you if you try to stay inside the store after being asked to leave for no reason, or if you try to leave. On the other hand, they can be absolutely tolerant of any customer who starts obnoxiously offending the victim and come down on them with hate. Obviously, this practice is unethical and needs to stop. I assure you that all those people, who support kicking people out of the store for no reason, will start talking differently after it happens to them.
