I was hit by an illegal alien who did not have insurance or a drivers license. my insurance company is refusing to pay for the damages to my car. they told me that they are not going to pay for someone who is not supposed to be driving on the roads of the united states. they also told me that they cannot sue or recoupe money from this illegal alien. i am stuck with paying, $7400 to repair my car. this illegal alien and my insurance company are getting off scott free.

i have been driving for twenty seven years and have never been involved in an accident; this is hell. my insurance company has pulled out all the legal guidlines to keep from paying for the repairs. i went to file a suit against this illegal and was told that he was returned to mexico. i was told to sue the owner of the car. the owner of the car has vanished. my 2008 dodge viper is sitting at the body shop waiting to get fixed. the shop has refused to start fixing the car until they get $4500 up front. i am stuck. Help! what can i do?

Don't you have collision insurance? What if you had hit a tree? The insurance company would pay for that and all it would cost is your deductible. You should also sue the company for a refund of the "uninsured motorist" premiums if they don't cover this.

Your rights against the other driver do not vary depending upon his immigration status. If he was permitted to use the vehicle, you have a right to make claim against the other vehicle's insurer for your damages and, if you were injured, your injuries. The owner of the car may be liable for the accident as well, since in VA the registered owner of a vehicle is presumed responsible for any accidents caused by that vehicle (that presumption may be rebutted by evidence that the owner did not in any way control the vehicle's movements.) You should contact the police in the matter to report the matter to them. Hopefully you got the license plate #.

Contact your own and the other driver's insurer to put them on notice of your claim. If you were injured, contact a local attorney for advice and for pursuit of your claim.

My wife was sideswiped by an asian tourist in a rental car a few years ago. The tourist "waived" the insurance coverage and the rental company tried to get out of paying. Our insurance company (State Farm) had no problem smacking that defense down and getting them to pay the entire claim plus the deductible.

What you should do is stop making up stupid stories.

Regardless of who was at fault, you have a contractual right to have your damages paid for depending on what your policy provides. Typically the at fault insurance company pays. If it is no fault then your own insurance would pay.

If you were injured in the accident and you were not at fault you would have a right to recover compensation for your injuries.

Speak with a lawyer before you sign anything.

Legally speaking an "illegal" alien can drive so long as they have a driver's license (that is current) from their own country right? (obviously they still need insurance for the car they're driving).

No, he or she is not. What I am saying is the excuse the illegal alien driver gave doesn't matter. When a situation like this happens, the best thing to do is call the police and give the license plate # and all relevant information.

yea if your story is true (ie, their is actually a defendant in the case who and was ruled as the cause of accident)

to repair it i only need a period of time where i am not harassed

Besides the likelihood of a company trying to get out of its uninsured motorist coverage obligation on the basis that the uninsured motorist was an illegal has to be close to zero.
