Very true.

However Trump has funding and can get more.

Also the issue that Congress can claim an fake emergencies and the President cannot - is total legal bunk.

The budget and military cannot be "faked" by calling it 'wholey congress's decision to not yield a military where necessary'.

Because as Dershowitz well knows near top of charter and responsibilities of congress is: TO FUND THE MILITARY.

so you can dance around all day but if the president say "WALL: NOW", he gets it

no one has said a WORD about military spending

obama inducted many mercenaries still active military in foreign countreis (which i call highly illegal - and some of them are spies). he CLOSED military bases that housed citizens, many scams were run against veteran / citizens during all this. (there was no excuse for seeking active military from other countries to hire into our military). many secrets were know to be lost during obama - HUGE ones (these are insanely expensive).

the point is: no one has even discussed if the Military got too much money or if congress still owes more.

so if funding isn't the point, what is?

obviously democrats are so frantic that republicans, if they get control, will arrest democrats for crime in politics (which is a GOOD idea), they are using illegal aliens as votes

DEMOCRATS HAVE BEEN SO FRANTIC TO SUPPORT ILLEGAL ALIENS THEY'VE FORGOTTEN ABOUT THE MONEY, that is, the budget process

money isn't the Point

protecting democrats from prison is the point

they're so scared they forgot about the budget - because they're facing jail time

here's a democrat area example:

(1) running corrupt courts

(2) running corrupt HUD

(3) running businesses without qualifications using illegal labor (that democrat political families own and run). fielding the resulting consumer complaints and insuring they get nowhere in court.

all of these are crimes, and it's a short list of the many scams democrats run

Dershowitz was once kind of a clever fellow, but in this case at least, he's lost his marbles. The President clearly has the power to declare emergencies, and the courts' will give him plenty of deference on that matter rather than doing any sort of second guessing.

Where Trump's whole scheme comes a cropper is in thinking he can then just move money around. This is what sank Truman in the 1950s steel case. Congress had a chance to vote in favor of wall-funding and flatly turned that down. Trump and the Executive branch cannot then come along and usurp Legislative branch authority simply because they disagree with the actions taken.

The day he declared the emergency he told the press that he didn’t have to, but thought it would get done faster if he did. Then he promptly went on a lavish golf vacation to mar a lago.

Those aren’t the hallmarks of an emergency.

Not to mention that for 2 whole years he didn’t declare one. The only material change after those two years is that the GOP no longer held the House.

In other words, it’s not an emergency.

Everyone knows this whole charade is phony through and through, but it doesn't matter in law if an emergency actually exists or not. The President has the power to declare one as he sees fit. There is no review biard that he has to go though to get to that point.

It's a different matter when he tries to invent things that he can do because of an emergency declaration, and that's where this whole stunt will ultimately collapse in a heap.
