Prince William police arrest video goes viral

A YouTube video showing a Prince William police officer confronting a man videotaping an arrest at a McDonald’s outside Manassas has gone viral.

The video shows three officers arresting a man in the lobby, with the person recording the arrest following officers outside. At the door, Officer Kevin Jennings tells the man recording to go back inside, but the man argues that it’s his constitutional right to tape the incident.

The officer doesn’t attempt to take the photographer’s phone and doesn’t tell him to top filming, but does threaten to charge him with loitering. The man then goes back inside the restaurant.

The man being arrested in the video was charged with public drunkenness, police said.

The video was posted on the website, photographyisnotacrime.com, leading to dozens of responses on the Prince William police department’s Facebook page Monday morning.

“Why are your officers infringing upon our constitutional rights to record in public?” one wrote.

“I suggest that the PW county police read up on the Bill of Rights with particular attention to the First Amendment,” wrote another.

Police responded to the uproar with a post of their own, saying they are reviewing the incident.

“ … We would like to point out that it is our policy not to impede on anyone's right to video our actions in public so long as there is no obstruction of or interference with police actions or anyone else's rights or safety,” police wrote.

According to the American Civil Liberties Union, anyone in a public place where they are “lawfully present” has the right to photograph “anything that is in plain view.”

The ACLU also says that police officers can order those who are “truly interfering with legitimate law enforcement operations,” to cease photographing.

Officer Jennings had no grounds to demand that the dude needed to go back inside. He was standing enough away from the action,not interfering at all. A law enforcement official who doesn't want her/himself being recorded on the job doesn't count as interference. Total abuse of authority. Someone should get this bully up to speed on current laws!

I did not hear officer saying not to record the video. He told him to go back in. Maybe because he is a K-9 officer and K-9 dog was on the scene. Maybe try recording a video at active shooting scene and see how that works out for you.

It does not matter if the officer has a sterling reputation, I do not give up ANY of my rights simply because I am in the presence of a police officer. If law enforcement officers are performing the duties that they have been hired for, they should gladly welcome any and all photography to show what an outstanding service they are providing the public.

Go reread my post, I never said Jennings told him to stop recording. I simply said that an officer not wishing themselves to be recorded didn't qualify as interference. The drunkard was in handcuffs, the dog was in the squad car. What harm was the recorder doing..hmm?

The solution is quite simple, and not really expensive.

Every police officer must wear a camera and microphone, recording at all times they are on the clock (except, e.g., while using the restroom, or having lunch).

This will cut down on officer mistakes, and, more importantly, on officer corruption.

Fortunately, we don't have that much corruption in Fairfax and Prince William, but there is a little.

It can be inferred as interfering as you are within striking distance of a wannabe SEAL.

However, in this video, the operator wannabes were walking away, and the person filming them was not advancing past the door.

Not to mention, that is a straw man arguement as your first claim was they can tell you to leave, then when I busted your ass, you moved on to following them up to their car, which is completely different.

This is a badly out of shape angry unprofessional cop. His actions are immediate and without thought or attention to training. There is no way that this guy does not act like this often. He is an embarrassment in a uniform. He looks like a middle aged, way out of shape fat guy. As a K9, there is not way this dude is in shape enough to track with a dog. What a farce, moreover, these are gestapo tactics that have no place in an " accredited department ", look a bit and you will find more unprofessional actions by this guy, simple put, he did it this time he has done it before, Loitering for walking out of a restaurant he was patronizing already. This argument is the one that really pisses me off when anyone catches the police fucking up. The cop Jennings, over steps his authority by going Gestapo on this guy videoing an incident. You have the right to video the police anytime as long as you do not interfere with them doing their job. You are an American and this right is granted you by the Constitution. NOW why would this cop not want this incident videoed? If the cops are doing their job correctly where is the harm. This cop violated this guys civil rights and threatened him with incarceration if he didn't obey his illegal command. The guy tells Jennings he has the right to video the incident, Jennings agrees! BUT still pushes him back inside without an explanation.

Cops are not like Lawyers and Doctors or anyone else like someone mentioned above. They are sworn Law Enforcement Officers sworn to uphold the law and allowed the right to take away your freedom. So videoing them, making sure they are doing their duty properly should be no issue. When cops deny anyone their right to video them it makes them look dirty and unprofessional. If Jennings had asked the guy to step back inside for the safety of himself and the other officers, you can video from inside all you want. This video would never have been seen, no one would care. These officers who command you to do something without explanation, who treat people like they are guilty of something prior to asking any questions. Anyone who spends 5 minutes watching YouTube can tell you that all it takes is a few bad cops to ruin the reputation of the 99% of good ones out there. This guy fucked up and should be held accountable.

The bullshit post about who you gonna call if you don't agree with this cop is just that Bullshit. He handles himself in a professional manner and we never know who Officer Jennings is, at least not in this video.

I've had the foot against my neck and bracelets on and gotta few smudges on the record.

Most cops are alright and just doing their jobs; a select few are militant nitpicking assholes.. But if you are a wise man, you can have a lot of fun out there and avoid,avoid,avoid them. Not that hard to do...

Wow, Policedapolice, exxagerate much to try and make your point? Telling someone to move away from an arrest situation is "going Gestapo?" The guy in question was within a few feet of a police car. These situations can escalate quickly, so I have no issue with the cop telling people to back up. In addition, the cop never said anything about the video, he just wanted the area clear. His voice tone did change when the guy wasn't complying and was more interested in arguing. I won't argue that there are some shitty cops out there, but I saw nothing in this video that bothers me in the least. Tell me Officer, why didn't Jennings just approach the situation the way I describe in my BS post? Why not just come at the guy with respect and an order rather than a demand that he "go back inside!" It is obvious he didn't want the encounter videoed. We all know it.

He has a right to video the encounter, when you cops acknowledge this right and stop hiding behind some bull shit wire tapping excuse then all cops will be treated with respect by law abiding citizens. Right now cops are being caught on tape showing their Gestapo mentality all over the country, that's why this video has gone viral. It's just another example of Cops abusing their authority, not knowing the law and not treating someone with respect. Jennings is a cop in Prince William County this is not Compton or Caberna Green, this guy was absolutely no threat to anyone and the asshole acts like he has a weapon and is endangering the arrest. Treat people with respect if you want respect. You serve the citizens of the jurisdiction you have sworn to protect and serve. I used to give the benefit of the doubt to the Police, not any more, and I guarantee you there are more and more people feeling that way as you see videos like this.

Officer Jennings never infringed on any rights. He never once told the man to put the camera down or to stop recording. In fact, he acknowledged the right to film. Officer safety was most likely his concern. Controlling the scene of an arrest and limiting the number of variables added to the situation was the right thing to do.

Seriously, do you really believe that Jennings was just controlling the situation? Did you see the video? There were 3 cops arresting a drunk at a McDonalds in PWC! This guy was videoing and was following them out of the McDonalds... its obvious he did not want the guy to video the arrest and that's why he pushed the guy back inside against his will, This is America, you have rights that this fat fuck with a badge cannot take away. I'll wait for the trial to comment.

My guess is the cop HUD system told him: your asshole drunk there had a history of belligerence and had registered a weapon in VA. It could have been a dangerous situation that he didn't feel like explaining to the twit with the camera.

Simply put: the mere sight of an officer telling a person to leave the area doesn't mean much. Asking isn't against the law - and possible a white lie about loitering isn't either (i'm unsure).
