The sons of Carol I. Glover, the Alexandria woman who died this month after being trapped on a smoke-filled Metro train, filed a $50 million lawsuit against the transit agency Friday, saying they hope that no other passenger will have to suffer the same fate as their mother.

(the law is obvious, she's dead she can't benefit, and her family doesn't deserve "compensation". there are legal limits on such suits. and one reason is if there weren't, then mobsters would kill people all the time for the chance at a suit. the limit of $10,000 - not worth it usually)

The incident was in January 2015. The operator could not have moved the train as it had been incapacitated by electrical damage. The suit brought by the Glover family was recently dropped because they accepted a settlement.

DO NOT BLAME THE TRAIN OPERATOR. As smoke began filling the tunnel and cars the train operator tried repeatedly to get permission to back the train up in order to allow the passengers to get out of the tunnel. The train dispatcher wouldn't give permission because the dispatcher was concerned about the possibility the train backing up would hit another train that was sitting in the station. Last report I read it still was not clear whether the operator of the train in the station had left the train or just could not be reached, and if the operator had left the train whether it was due to instructions to evacuate the station.

Whether the train in the tunnel COULD have been backed up is an open question. What is clear is that the dispatcher sitting safely miles away intentionally left this woman and her fellow passengers in deadly peril because the dispatcher was too damn chicken to authorize the train operator in the tunnel to take the one action which had the best chance of getting the passengers safely out.

The only true justice in this case would be to force the train dispatcher to have to listen to tapes of the people trapped in the train which was filling up with smoke for all eternity. A pile of money is the best we can do. Sadly that money is coming from Metro riders and area taxpayers, and not from the people responsible for this woman's death.
