Right to Take Pictures of Federal Facilities

At Claude Moore Park Sat. and my nephew took a picture of the fence of the George Bush Center For Intelligence (a sign on the fence had faded so instead of saying 'No Trespassing' it just said 'no'). Cop drives up and asks him to delete the photo. He took the photo from the park, across a public road from the Federal Facility.

The intimidation worked we all just let the cop perform this detention/seizure (asking someone to delete a photo is seizure). My understanding is that this is a permitted activity under the constitution.

You can take all the pictures you want so long as you're not on the property. I got the same reaction at an FBI facility, where I was a contractor and was authorized by the FBI to take pictures anyway. It's a training issue.

It is legal to take pictures of a Federal facility so long as you are on public land accessible to the public or legally on private property, and so long as you are otherwise obeying the law. The FPS has admitted as much in its directions to its security officials after they got nailed in a lawsuit.

I believe the CIA has its own security service, so they are not subject to the FPS Directive. I'm not sure about the U.S. Park Police. However the same principals still apply. The problem is that in this post 9-11 world security officials and law enforcement officers are still going to throw their weight around. If you do not comply there is a good chance they will hit you with some bogus charge. Disorderly conduct is a favorite. Then you will end up with no picture AND a criminal record.

There are some websites indicating what police can and can't do when you are taking pictures from public areas, and how to deal with them.

asking someone to delete a photo under authority of law is a seizure - he needed probable cause to even investigate the photo taking. He never identified himself and he never explained the nature of the investigation. When my sister asked if she could take a photo of the sign 'George Bush Center for Intelligence' the cop said 'we'd prefer you didnt...'

It was intimidation pure and simple. 3 generations of my family, Grandpa, my sisters, their husbands and kids. We were sitting at a picnic table by the gift shop off the parking lot. On park land enjoying the day after the fish salting demo at Claude Moore. No indication this was in anyway a planned or covert picture taking outing. Just an ass in a uniform probably ignorant of the law or simply a jerk.

The CIA, DIA, NGA, and NSA all have accredited police forces. Even the FBI has its own police force to provide physical security that is separate from their Federal agents.

Huh? The event happened the way I described it. I agree it was an absurd attempt at enforcement of an imaginary law by the cop. As soon as he left we could have taken as many pics as we wanted. Further we could have videoed the entire fenceline as we drove out of Claude Moore. As you have shown there are pics on line of some of the signs (though we were on the double barbed wired fenced side facing Claude Moore not the 123 or 193 side you show in your photo).

I suppose an app duplicating photos is another possibility. In point of fact the cop never even moved away from his car to confirm my nephew even deleted the photo. He just got out of his cruiser and stood next to the driver side door.

Its hard to know what to say when authority asks you to surrender your rights. For most of us we run into officers so infrequently that we assume they are truthful and have our best interests in mind. Sometimes they do but they are not required to do either. Officers use lying as a tool to extract information and evidence. Officers use intimidation to get people to give up their rights. Thats the way the world works...

On Bolling AFB they have signs on the fence around the president's heliport saying no photography in this direction. I guess it's a military base though so it's different laws.

Cops always lie. It's how they get trained. Not until they are under oath should one start to maybe think the truth is being told. All cops just want a reason to get an arrest on their file. It's a bonus system.
