obama cannot accept a resignation from a US congressional agency and appoint someone from his own cabinet (technically that means it's congress's responsibility (cough) which the agency fulfills on congress's behalf)
congress has already lambasted the president for installing "picks" without approval
(newly a president has funding for a cabinet. congress also lambasted obama for using too much money and hiring too much staff to OMB: which used to be size $0 and 0 persons until somewhat recently. obama did not create omb as part of the presidents cabinet but expanded it.)
this is not a good move for obama. cute pick though !
