Moped on Route 28 every morning

Anyone else see that guy on the moped every morning on Route 28 heading towards Dulles from Chantilly? He has on a reflective vest and about 4 cars lined up behind him because he can't get that piece of shit up to the speed limit of 55. I thought Mopeds weren't allowed on major roads like that.

I don't know. I saw that post a short time ago. This guy I saw had a helmet on and a yellow and orange reflective vest on him (too big). Might be the same person. He was nowhere near 55 mph on Rt. 28 though, very slow, even for a moped.

There was a time my license was suspended for 3 months (reckless driving on 81 near the N.Carolina/VA border) and I had to commute from Sterling to Fairfax....

Using Google maps "Street View," I plotted a route from Sterling to Fairfax that didn't include any roads whose speed limited exceeded 35mph....Then I bought a scooter and commuted with it....

Even with a quality Honda scooter - I didn't feel safe because those scooters don't have enough power for anything more than puttering around an OldTown Fairfax-like area....

There's no way I'd ever venture onto 28 or LRT.....and my understanding is that scooters aren't allowed on roads with speed limits exceeding 35mph.....

My question would be this...If a moped's top speed is only about 45mph and Rt 28's speed limit is 55 MPH, then would the Moped driver be ticketed under code #46.2-877 for Minimum Speed Limit: No person shall drive a motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic? Which is what the OP said the Moped driver was doing.

Is there a legal difference between mopeds and scooters? I think what we are talking about here are scooters, which are motorcycles with engines of 50cc or smaller. I know you need at least license plates, insurance, and a helmet for a scooter. I think that's it though. Most scooters only do about 35mph. However the Yamaha Aerox and Aprilia SR50 Ditech will do 55mph without modification. No motorcycle license needed.

Agreed. He could be relying on the government, but instead is at least, to his credit trying to make ends meet on his own. That deserves some credit, although I think I've been behind this same guy on Rt.50 and it does make already bad traffic that much worse.

There is no legal difference between a scooter and a moped. The size of the engine is what matters. UNDER 50cc's is a moped regardless of what it looks like. Most "50cc" mopeds are actually 49.9cc to comply with the law.

You DO NOT need a plates or insurance to run anything under 50cc (scooter/moped/bicycle-modded-with-a-motor) UNTIL July 1st 2014. After that everything needs plates.

If you go over 35 mph on a under 50cc engine, the law says you are riding a motorcycle and can be cited for driving a motorcycle without a license.

Now you've been schooled. Now you can say "I know"

Interesting. Where I grew up, having pedals made it a moped; it could be under 50CC and still be a "motorcycle". This was back in 1981, mind you.

That mattered, because they had a hellish "road test" that included things like doing a slalom between cones at low speed -- not bad on a dirt bike, but impossible on, say, a Harley. I had a Honda 400 and failed the first time; a buddy had a 49CC "NOped" and I retook the test on that and passed.

When I retook it, a 1%er with a chopped Harley was trying to pass on that hog. I think with the raked fork, its wheelbase meant that he'd've had to wheelie the slalom! His buddies were killing themselves laughing watching (as were the rest of us -- well, we were trying not to show that we were laughing, on the theory that he wasn't likely to be in a good mood, and we sure didn't want to focus his ire on us!).

The funniest part was that everyone who wanted to take the test rode their bikes (illegally) to the DMV; if we failed, we rode 'em home. Definitely some wink-wink there, as if they'd given a hoot, a single police cruiser would have put a stop to that in a hurry!

mopeds under 50 cc, are not allowed on any road 40+ mph. they have to stick to 35+ or less. if its a registered moped over 50 cc, then they are treated like a normal motorcycle, and have to be registered, inspected, and operator must have a mc license. if the moped is going over 35 mph on a road and its unregistered, that is also a ticket, because if it is going over 35 mph, its also over 50 cc.

Ah! The motorcycle test now has a figure 8 tight curve. But larger motorcycles have a larger 8.

Its easier to take a MSF class than go to the DMV for a test though. The class provides bikes and has a test at the end that grants you your license.

BTW there are still many many unlicensed bikers. I had a couple bikers in my MSF class who came on bikes, failed and left on their bikes.

I guess some things never change!

Yeah, I took the MSF class back then, too: my parents said, "OK, you're legally an adult and living on your own and all and we can't stop you from buying a bike, but if we pay for this class, will you take it?" and I said "OK". One of the smartest things I ever did. But back then the class didn't get you your license (this wasn't in Virginia, either); in fact, I'd been riding for a few months when I took it. It would be great to take it before to get your license, and then again a few months later (perhaps a slightly different curriculum?) as a real-world update!

And yeah, sounds like some things never change re unlicensed riders!

I got my first motorcycle when I was 21 because I couldn't afford a car insurance premiums.

I already had my license when I took the MSF class. I believe that it has saved my life many times over. At the very least, it prevented the fatal mistakes.

The class is fun. Those small 250cc bikes are fun to ride and are very easy/forgiving when making mistakes.

FAIRFAX COUNTY, Va. (WUSA9) -- Mopeds, mini bikes and electric scooters seem to be everywhere on the roads these days and they are posing an increasing danger.

Last year in Virginia there were nearly 600 crashes involving these vehicles. Twelve of the accidents were fatal, including one that killed a 17-year-old Fairfax County boy who was riding a moped.

Fairfax County Police held a course Thursday for patrol officers to help understand the difference between these vehicles and the new laws.

If you're riding a moped in Virginia, you must be at least 16-year-old old, have a valid government issued photo ID, wear a helmet and safety glasses.

Mopeds are legally not allowed to go over 35 miles per hour. If they do, they are subject to the same laws as motorcycles, and have a valid license to drive it.

Officers are now enforcing the new laws and giving out information to drivers about the new changes.

1) there is no registration for mopeds on you own property, or bicycles

2) anyone on any road shared with cars needs a license and to be insured, not necessarily a car drivers license, whatever floats DMVs boat.

3) some mopeds can get on the highway - depends on model and highway and way the thing is advertised. obviously you cannot come to court claiming you were doing 40mph in a 55mph zone and blame it on the manufacturer.

"moped" is not defined. and the old definition is far different from new, they had been made like powered bicycles in the past, and today as far as i know they are all direct drive and higher powered (not mopeds)
