Legality of Issuing Speeding Tickets via Readers?

Anyone know if it would be legal for a county or state authority to issue a speeding ticket based on average speed between passing two plate reader / EZPass devices? I suppose this could be accomplished in a few other places too, namely the hot lanes on 495. However, these readers are real close together on 66.

Is there a law that prevents speeding tickets being issued similar to how they are with speed cameras or red light cameras? It would suck if they do that.

It would require a change in how speeding laws are currently interpreted. If an officer pulls you over and gives you a ticket for doing 15 mph over the posted limit, it requires the officer have proof that when he observed you, you were doing at least 15 mph over the limit.

Using a between the readers method means that a ticket could be issued for doing 15 mph over the limit even though the driver was not ever observed doing that speed. I could for example be driving through both the readers at the speed limit but at some point in between have done 25 mph over, so I averaged out at 15.

Honestly I'm surprised that they don't do it now. could have done it on the dulles toll road or even places like the NJ turnpike...

In england they monitor traffic in construction zones with average speed cameras. and issue tickets accordingly...

Transurban is working on the program to put this method into practice. They will collect the money on behalf of the county/city for a percentage of the fees/fines.
