Unwanted firearms to Fairfax County Police

I have an unwanted firearm and some ammo. Can I take it concealed to a police station for destruction?

I don't have a CCW. Will I get charged for concealed carry?

Do I open carry into a police station? Will I get shot?

Has anyone done this and knows how I should go about it?

It's a cheap Saturday-Night Special and I'm afraid it will get into the wrong hands so I'd prefer to have it destroyed than make a few bucks.

Leave it in the trunk of your car. Walk into the station and tell them what you want to do. An officer will walk out to your car and retrieve it with you. Safest way.

Put it up for consignment through an FFL. It would be better for society than handing it over to those jack booted thugs.

Give a poor person the chance and means to defend themselves. Self defense isn't just a natural right for the wealthy and middle class. Poor people need weapons, too.

It's from Colt and it says Python on the side.

It is very heavy. I think it takes 38mm or 357mm ammo.

I do the keep it in trunk thing with fcpd tomorrow morning.

walk unarmed into police station and tell them you want to turn over a firearm. they will have a cop meet with you so he can write a 3 sentence report. then tell the cop your firearm is in your car. make sure it is unloaded and you are not a felon if you want to drive home from the police station and not take a cab from the jail. cop will try to convince you to sell it to anyone so he will avoid the report and paperwork - plus why not sell it for any amount of money?

If you give the gun to the police, it will eventually end up on the rack at an FFL dealer.

§ 15.2-915.5. Disposition of firearms acquired by localities.

A. No locality or agent of such locality may participate in any program in which individuals are given a thing of value provided by another individual or other entity in exchange for surrendering a firearm to the locality or agent of such locality unless the governing body of the locality has enacted an ordinance, pursuant to § 15.2-1425, authorizing the participation of the locality or agent of such locality in such program.

B. Any ordinance enacted pursuant to this section shall require that any firearm received, except a firearm of the type defined in § 18.2-288 or 18.2-299 or a firearm the transfer for which is prohibited by federal law, shall be offered for sale by public auction or sealed bids to a person licensed as a dealer pursuant to 18 U.S.C. § 921 et seq. Notice of the date, time, and place of sale shall be given by advertisement in at least two newspapers published and having general circulation in the Commonwealth, at least one of which shall have general circulation in the locality in which the property to be sold is located. At least 30 days shall elapse between publication of the notice and the auction or the date on which sealed bids will be opened. Any firearm remaining in possession of the locality or agent of the locality after attempts to sell at public auction or by sealed bids shall be disposed of in a manner the locality deems proper, which may include destruction of the firearm or, subject to any registration requirements of federal law, sale of the firearm to a licensed dealer.

While it's fun to think that the police department and county government have been illegally destroying guns, Virginia law requires that surrendered guns be sold only if something of value was given in exchange for them.

A quick cruise through the county code of ordinances at http://library.municode.com/index.aspx?clientId=10051&stateId=46&stateName=Virginia reveals that no ordinance for any sort of "gun buy-back" program exists in Fairfax county.

If you just give a gun to the cops and don't get anything back, it looks like they can do anything they want to with it, including destroy it.

I'd be surprised if more than few dozen guns are surrendered to the FCPD in a year.

Finally, if you want to destroy a gun, a few well-placed whacks with a heavy sledgehammer is all you really need, especially for a mostly zinc and aluminum gun like a Phoenix. If you make a YouTube video of it you'll get all sorts of interesting responses.

It needs to be melted down and turned in to dog food cans to protect the children.
There's nothing more important than protecting the children. Every gun owner should pay in advanced when they buy a gun to have their gun melted down when no longer wanted or allowed by the Government.
