It wasn't a special election, you idiot. Virginia's gubernatorial election always takes place the year after the Presidential election. McDonald's term was over.

That's correct. It's a grand jury, and the rules are different, because his liberty is not at stake. It's only an indictment, not a conviction.

If you filed it in federal court, I'd imagine that it got tossed sua sponte on 12(b)(6)/42 U.S.C. 1915(b)(2)(E) grounds. Alternatively, you probably didn't pay the filing fee or meet the requirements to have it waived.

I defy you to show me one example of that ever occurring in the Commonwealth, and that example had better be caselaw. At any rate, that's not applicable to the present case, because it was a grand jury/indictment situation, and the only determination (and thus, the only instruction) is whether probable cause exists.

The prosecutor and defense attorney may both submit jury instructions, but the judge ultimately rules as to how the jury will be instructed. Again, irrelevant.

This was not a trial, and he wasn't ousted (oh, also, there is no "especially" here - Governor McDonnell's trial will be the same as any other citizen).
