Spouses Debt

I am still legally married. Lived separately from wife for almost 3 years. she has tons of debt, in collections, and no money. she is in jail. I've filed income taxes separately for three years. Custody - done. home -sold. proceeds split. all finances are separate.

My question is.....although the massive debt she has accrued are all in her name, is there any way that I am legally responsible or can be collected on?

Seriously, pay $40 for a RocketLawyer.com account and ask a lawyer there. Laws differ by state. I went through an eviction process, and the lawyers on-call there were really helpful

My general instinct is no, you're not liable; it sounds like you don't have any shared assets with your wife. Your car's only in your name right? Retirement accounts only in your name? Back accounts only in your name? No social security income yet you'd need to split?

Generally, all debt collection that has teeth goes through the judicial system. Your wife might be sued, and if successful, a judgement could be attached to her assets, and if you share those with her, you could be affected. Sounds like your finances are separate at this point though.

Seriously though, ask a real lawyer.

Debt collectors will try to make you pay. They may even sue. The truth is you are not liable.

They came after my sister for our stepmother's debts. We hated our stepmother, told the collectors to go down to hell where she was and take it up with her directly.

Do you want to rely on the advice of a lawyer who you might be able to sue if you are given bad advice...or do you want to rely on the comments of total strangers who may or may not know what they are talking about?

If you are just asking out of curiousity, my gut says you would not be liable for breach of contract unless you were a party to the contract. You might be liable for "necessities" provided to your spouse.

legally arguable, argument is allowable

depends if i'm a collector i'm saying yes

if i'm a judge and atune to politically rich - i'll always side with the collectors and government side

if i can get away with it

that's a tough subject. your asking the judge to be an accountant and review spending. big companies do that all the time: it costs taxpayers millions - because big companies use federal judges as their personal accountants

Look up 'doctrine of necessaries' - if none of them apply, you are probably not liable.
