Can anyone tell me what do u think will happen in the court. I was going 88/55, i have a lwawer and have completed a driving improvement class. Does anybody think they know what will happen.

You're paying a "lwawer" to answer those questions, ask him.

Well if your driver improvement class was for previous infractions, they won't care that you took the class, they'll only care what you're previous infractions were for. My guess, a pretty hefty fine and possibly some suspension of your license. But it all depends on how the judges day is going.

I agree with Trogdor. Without more information (location, time of day, driving record) it is hard to predict. Even with that information it could depend on what judge you get and their mood. But the hefty fine is almost definite and the license suspension is likely.

first offense? any record? a lot of that may have something to do with sentencing.

i guess 88/55 is still *only* reckless driving, so if it's your first offense and you've already done driver improvement, the only thing left is for you to wait and see what happens.

no jail time but I would count on the six months suspended. I was nailed for 94/65 (less total miles over but worse in the eyes of the law), and I got a lawyer. He got it reduced to two months suspended and a fine, 300 bucks I think. The cop who pulled me over SWORE I would do no less than 6 days in jail (3 days in jail and 3 days off for good behavior).

Then again, my shit was in ultra-lenient PW county, so... YMMV.

You'll be fine. If I recall correctly, VA will only jail you if you're going over 100mph. And generally then it's 1 day per mph over.

It is, of course, all the whim of the judge, but that's the average treatment.

For comparison about 6 months ago I was caught in Roanoke county (down 81 near Blacksburg) going 85 in a 60.

I got a $750 fine and 90 days suspended license. The fine sucked, but the suspended license was unacceptable, so I appealed. $886 fine after court costs and no suspended license.

Then again I have an awful driving record so your punishments should be much more lenient.

Say bye-bye to your license for 6 months, and if you are lucky, no jail time. I heard that judges are now issuing 1 day of jail for each mile over 80, or is it 90? Anyway, I suggest you get a lawyer.

there is no chance he goes to jail with a lawyer and a +5 record (the class). The judge at my trial was all over my driving record. He apparently only looked up five years worth, because he thought I had a good record, which I had for the five years prior to that date.

Good thing he didn't see the five years before that.

I have taken the drving class to help improve me chances. Is that correct? The DMV or court did not tell me too. So is there any way i could not get make lisence taken??

Taking the driver improvement course before your court date does not count.

You will still get a notice after your court date telling you to take the driver improvment class. You can't be charged for than $75 fot it either.

You will not get jail time and you may not even get your license suspended. I just went through this in Shenenndoah County. Got a $200 fine, no suspension, have to take the driver improvement class.

There is no way that i am going through that Driving course again. Also if the lawyer and poice man strike a deal, will i have to see the judge?
