Do you pay her at all?

Chances are if it is an individual the unwillingness to accept checks has little to do with taxes. Instead it is more likely that either she is trying to avoid paying check cashing fees or she is cheating on her welfare. There is also the possibility that her landlord or others she is dealing with only accept cash (because THEY are cheating on their taxes) and she doesn't want to waste some of her work day going to the bank to cash the checks.

If you are using a service rather than an individual, then if they won't accept checks they are probably cheating on their taxes. It likely isn't just income taxes. They're also skipping out on their obligation to collect and pay over withholding taxes and their obligation to pay unemployment taxes and BPOL.

For the OP, if your cleaning lady insists that you pay her with cash. But, you should confirm with her that she has a SSN. Then, at the end of the year, issue here a 1099 form for her work during the year.

She'll realize in no time what kind of mess she'd be in. No taxes deducted during the year, and she also didn't pay both sides of the social security tax witholding as well as Medicare withholdings. She'd probably cuss you out for 15 minutes straight in Spanish while you would just have a grin on your face.

If someone wants to work for me like that, I'll pass on them. Eventually, people who pay with cash will only be screwing themselves because their Maria, the cleaning lady, doesn't pay taxes, yet uses many of the services offered.
