I agree with the original poster of this thread. This site is garbage, shit talking and completely defames thousands of people, places and institutions. First amendment is fine and great but when civil rights are violated, alleged cops and ex cops come on here posting case sensitive information, etc. Cary is playing with fire, and from someone who has personally been defamed on this site, I really hope it burns to the ground. If people wanna wave the 1st amendment around and take it literally, then felons should be allowed to bear arms according to the second amendment. There is no "constitution" anymore, not that I've seen in the horrible county of fairfax. It is run by the corrupt kaki collard storm troopers that arrest just because and charge cause they can. Can we all please get the First Amendment right? It applies to the Government, not individuals. If an individuals posts something that one considers libel or slander, then the victim's recourse against that indivdiual is a lawsuit. Truth is a defense to libel and slander, although in some cases, such as the posting of health and other protected information, if the information was obtained through illegal means, the truth defense won't hold.

The First Amendment was written to prevent the Government from suppressing information and opinion critical of the Government or suppressing speechin general. In other words, the Government cannot unilaterally shut this site down. Any attempt to do so would be a First Amendment violation. The First Amendement starts with "Congress shall pass no law...".

Private citizens don't have "First Amendment" rights against each other. We have that right to protect us against the Government. Period.

Cary has a First Amendment right to post, and allow others to post, anything on here that relates to the Government - police, schools, elected officials, public employees in their capacity as such, etc. Anything posted about private citizens that is unrelated to the Government is not protected by the First Amendment. So, calling a private citizen a slut or a thief or scumbag is not protected by the First Amendment. If the person feels victimized, they can sue and try to get the ISP of the original poster and sue that person, not Cary, because Cary didn't post it. He's just the medium. Actually, they kind of do. If OP is butthurt about perceived slander against him and decides to take legal action against Cary, other posters, etc. he will do that through the courts, which are government. And, those courts will use government law to determine whether there's merit to the case before adjudicating it and if they take it up they will use government law (and facilities and personnel, but that's somewhat tangential) to make a legal decision.

So yes, in a sense we do have first amendment rights protecting us from one another.

Nope sorry, this is just wrong. The first amendment has to do with a constitutional right against government interference with speech, religion, etc. Suing someone for libel or slander is a tort created by state legislation.

A police officer entering your home without a warrant could be a 4th amendment violation. A private citizen entering your home without permission would be trespass or breaking and entering, which are statutory violations.

Also, what exactly is "government law?" This sounds like some made up jargon someone uses when they don't actually understand how our government or legal system work.
