My complaint with the airport police is ticket prices for airfare went up for increased security at airports. Not sure what running radar on Rt 28 has to do with increased security.

It's open to the public IF you're on airport business. Sort of like how HOV lanes are open to the public IF you have the minimum # of people in the car. I don't think your case would get very far...

Getting lost isnt a crime though neither is "forgetting" something at home. Then theres the whole issue of police giving state tickets on private property if they go that route.

I agree it would probably fail but the justification is basically because we said so and want the money.

The law says you must conduct business at the airport. That term isn't specifically defined within the law, but not many judges are going to buy turning around in a parking lot as conducting business. If the hotel gift shop is open -- most of course are not at 6:00 am -- you could buy something there and keep your receipt. Otherwise you're stuck being the 10th or 12th dummy standing in line to pay for coffee and a twinkie at the gas station. The state decides what you may and may not do on public roads. Best just to drop the macho lame-ass pretense and simply accept that fact.

Meh...some people drive to work and then get their coffee and breakfast from an overpriced "café". I bring breakfast from home and stop at the convenience store at Dulles to get my newspaper. Then I proceed down the Access Road and avoid paying the toll. I've been doing this for 17 years. Oh, I've been stopped a few times but, I show them my receipt and I'm on my way.

You do the math on what I've saved by not paying the tolls...

Do the cops really have the time to follow me to the hotel parking lot and see if I "conduct any business"? If they do, then we have way too many cops with nothing to do.

Buy 1 cent of gas at the Exxon station next to the rental car returns and keep the receipt for the cop/judge. Or is there a minimum amount of "business" that I have to conduct stated in the statute? If a cup of coffee is ok...

If the toll road is jammed up it's certainly easier and cheaper than paying the tolls.

Police are cracking down on drivers who skip the Dulles Toll Plaza and use the access highway illegally.

The access road running parallel to the Dulles Toll Road is supposed to be for people going to the airport.

"I follow the rules and I see most other people follow the rules, but some people don't,” Raul Woodley said.

Basically, some drivers use the airport access highway as part of their commute and avoid the tools, which help pay for the Metro Silver Line and maintenance and improvements in the Dulles Corridor.

So police launched a highly visible enforcement effort. Electronic signs alerting drivers to the enforcement were placed at key points and police, some in unmarked vehicles, pull drivers over when it becomes clear they aren’t there for the airport.

"We issued 50 violations the other day, two additional violations for reckless driving,” Metropolitan Washington Airports Authority Police Chief Stephen Holl said. “Officers, state troopers and Virginia State Police assisted us as well."

“Backtracking” violations carry a penalty of three points on the license and fines starting at $92. The fines are paid to the county where the violation occurs.

Some drivers use a loophole: They will stop at a gas station convenience store on airport property, buy something like a cup of coffee, and use the receipt as proof they conducted airport business. MWAA police said they can't stop you from doing that.

If you’re thinking about using the Dulles Access Highway for “non-airport business” to avoid tolls or traffic, it will cost you. That’s the message Metropolitan Washington Airports Authority Police Chief Stephen L. Holl wants to get out to the public.

To get that message across, MWAA Police are currently posting special patrols to catch drivers making u-turns at Washington Dulles International Airport simply to avoid use of the toll road. This illegal practice is known as “backtracking” and is punishable by a monetary fine and lost points on a violator’s drivers license.

“Backtracking is a moving violation that carries a penalty of three points plus fines beginning at $92. It is cheating and it is illegal,” Holl said. “It’s not fair to those who play by the rules and stick to the Toll Road for commuting and local travel. Our ongoing efforts to curb this illegal practice will help ensure the access highway is used properly.”

Mobile electronic signs placed at key points around Dulles International Airport currently advise drivers of the enforcement action. Police — some in unmarked cars — will pull over and ticket drivers once it becomes clear they are using the Access Highway without conducting airport business. According to Holl, official “airport business” is a somewhat cryptic term that can be redefined each year by judges hearing the cases of ticketed drivers pleading their cases. Nonetheless, police will ticket anyone suspected of the illegal activity.

“We give out about 1,000 tickets for backtracking each year,” Holl said.

According to MWAA, the Airports Authority does not receive money from these fines. Instead, fines are paid to the county in which the citation is written. Revenue from the Dulles Toll Road pays for the operation and maintenance of the road and helps fund construction of the Metrorail Silver Line in the Dulles Corridor.

“The majority of the citations are issued in Fairfax County,” said MWAA spokesman Rob Yingling.

According to Yingling, besides illegally avoiding tolls and traffic backups at toll booths, backtrackers also reduce the convenience of the Access Highway for airport users and add extra congestion to the HOV segment of I-66 inside the Capital Beltway, which has exceptions for airport traffic.

MWAA operates and maintains both the Dulles Airport Access Road and the Dulles Toll Road and manages construction of the Metro Silver Line project.

“No taxpayer money is used to operate the toll road, which is funded by toll revenues, or the airports, which are funded through aircraft landing fees, rents and revenues from concessions,” said Yingling. “The Silver Line construction is funded by a combination of toll-road revenues, airport contributions and federal, state and local government appropriations.”

MWAA employs its own police force to maintain order along both the toll road and access highway and in both Dulles and Reagan airports.“We have about 220 police officers total,” said Holl.

It sounds to me like the no one knows what the law forbids until they get to court. To me, that means it is unconstitutionally vague.

How can we be expected to obey a law that doesn't specify what it forbids?

I got a ticket one time years ago for using the airport lanes.

It was a "failure to obey a street sign" ticket, carried a minimal fine & no points.

There are/were signs strategically placed saying the lanes are for airport use only. I have no idea what this "backtracking" thing is.

Maybe just a scare tactic to make the threat sound worse than it is?
