Vandalism - what can I do to them?

Our street was vandalized last night and after hearing a commotion, I looked out to see three teenagers getting into a car. At the time, I didn't realize they had just thrown eggs at cars. Not the end of the world, I was a teenager once.

My question is what would have happened had I handled the situation myself? While I own guns, I would never use them in a situation like this. Would I be getting myself into trouble if I were to hypothetically harm them or their vehicle in retaliation?

Again, I'm just curious. Not saying teenagers throwing eggs need to be shot or seriously injured.

No, but that's just because I was faster. And I didn't retaliate - I guess the question is whether I'd be justified in beating the shit out of someone, with our without a weapon, for damaging my property? I assume I cannot with a minor, but what if they're over 18?

You're assuming that you'd win a 3-on-1 fight, and that the 3 don't have weapons. Big, big assumptions. And if you chased them down while they were running away, you're the aggressor, not them. Take some pictures of them and their car, or at least get their license number, and call the cops.

The Constitution has nothing to do with this as Virginia code regulates this sort of issue. No, I am not kidding. I've done far worse things in defense of this country. I'm absolutely prepared to protect myself and my belongings. No, I don't plan on injuring a teenager throwing eggs, but am asking at what level I am allowed to use force in defense of property? Somebody comes and damages/takes your stuff and you decide to do nothing about it? Not my problem but not everyone is so willing to roll over.

I agree with your line of thought, uFHMn. Anyone out looking for a fight is just asking for it, this is completely reactionary. However I was curious about technicalities of the law.

To further clarify, fully detach from this teenager/egging incident. I have called the police - not because I think they'll do anything, just so that a report is filed.

Assuming there is a much larger threat, for example, someone breaking into my car while it is in my driveway. To what extent can I protect my property?

You cant use force to defend property under normal times. Only to defend your self or another person when others use force against you.

Give some kid a whippin over egg throwing and there goes your house in a lawsuit, plus you will be the one arrested.

Get a discription of them and call the police, dont make a bad situation far worse for you. Leave petty crimes to the police, dont get involved

If some one is doing something to your property that is a felony, Trying to start your place on fire. That serious. Throwing rocks threw the windows,Then yes you can physically take them down and hold them for police, If their arms get a bit twisted out of joint well that happens.

If the house is occupied especially by the very young or old, babies or infirm and not able to get out of the house on their own, you probably could shoot a person starting your house on fire. You'll be explaining yourself to a jury though.

youd get in trouble with the law, and the severity of the "punishment" you administer will dictate how much trouble.

a friend of mine, while driving his son to school, had some moron paul VI student make a left across traffic right in front of his f150 - while he was going 35 down main street. and by right in front i mean he had no time to even put his foot on the brakes. tboned the dipshit, in a volvo, and had a passenger been in the car they most likely would have been killed or severely injured as the door was smashed in to almost the center console.

he gets out and my buddy confronts him, grabs him by the coat and says "what the fuck are you doing you fucking idiot!". that's it, just a grab of the coat. no hit, no forceful shaking, just a grab.

bang! simple assault charge. the charge was dropped or suspended, but the court ordered him mandatory anger management classes along with a year of probation. cost several thousand dollars in attorneys fees.

you pound somebody for egging your car.....you can bet you'd have a bit more handed to you by the law.

What a great idea. So before you beat the shit out of them, you are going to ask for identification of some sort just to make sure they are over 18? Write back and let us all know how that works out for you. And take a great big chill pill.

I have training and experience that allows me to evaluate a situation far better than you. Someone commits a felony against me and/or my property, I'm prepared to address it. Moving from Texas, I am asking how situations are handled here in VA as we were given some "room to work" where I'm from.

In Virginia, the use of force in defense of property is not legally justified. You may only use defensive force to protect yourself or another's person.

I'm aware, it was a simple internet search into VA code, no need for a lawyer. While laws dictate certain statutes, some areas of the country have unspoken rules that sometimes supersede the law. Depends entirely on the officers responding. That's why I came here for opinion, but seeing as everyone's scared of everything in Northern VA, there's apparently no room for interpretation.

And I'm fully aware that unless someone is committing a relatively serious felony (which I've pointed out multiple times), the use of violence isn't justified. I do know nothing of your training/experience other than there is a <.05% chance it's greater than mine. Just because I'm capable doesn't mean that I'm hoping to act. I was stationed in TX, you won't see me catching any feelings in regards to that - I agree to some extent. This area is really soft in comparison, though. Tons of bureaucrats.

Not true. While you may not use DEADLY force to protect "mere property" other than in cases where there is a perceived risk of serious imminent hard to you or others, you certainly can use APPROPRIATE force in light of the specific circumstances (as would be deemed "appropriate" by reasonable persons). e.g., If someone were attempting to steal your wallet, purse, car, etc., you clearly can engage them physically in attempting to stop them (and as otherwise necessary to protect yourself in any ensuing fight, etc). You may not continue to beat them to half to death in the process of doing so.

Some of you folks seem to have been conditioned to believe otherwise, but the right to protect one's property is one of the oldest established legal rights under virtually every legal system.

In fact if you just fire a gun in the air in Fairfax county and there is another person present you must serve a 10 days in jail for dis-charging a weapon.
