What to do if someone refuses to give your belongings back?
Posted by: NeedHelp ()
Date: November 14, 2013 10:41AM

I met this girl at VCU 3 years ago and I thought that she was my friend. Whenever she needed to borrow clothing, I always let her. I usually try to do things that I hope others would do for me. However, she decided to stop speaking to me, yet she refuses to return my belongings. This situation has now elevated, she has almost $500 worth of my clothing and belongings, she refuses to answer me, and I see her wearing my clothing with her other friends. Does anyone have any suggestions of what I could possibly do? Any suggestions would be greatly appreciated.

You could notify the police, for one.

You could also file a Warrant in Detinue with your local Small Claims Court at the appropriate General District Court (I assume it's Fairfax).

http://www.courts.state.va.us/forms/district/dc404.pdf

They'll issue a summons to your former friend. If she shows, you'll both take your case before the judge. If she doesn't, you'll win by default judgment and the sheriff will be empowered to seize your property back for you.

Oh, and make sure to emphasize that it did not become clear to you until recently that she did not intend to return your property (that's the truth, right?) to avoid any statute of limitations issues that might arise.

On the civil side of things, you could sue her for breaching a verbal contract. But the lawyer will cost way more than the clothing, and you'll probably lose unless you can prove that you bought that clothing and it wasn't a gift to her. But the statue of limitations for verbal contracts is 3 years. From the criminal aspect, it would be considered petty larceny for anything <$200. And the statue of limitations for misdemeanors is 1 year. For >$200 it's grand larceny, a felony. And I believe there isn't a statue of limitations for felonies in Virginia. In short, you have four choices: sue her, call the police and accuse her of petty larceny for everything within 1 year, call the police and accuse her of grand larceny for everything, or do nothing.

I would suggest doing nothing, and not bending backwards for girls in the future. The fact that you state the gender of the "friend" shows to me that you think women are sex vending machines that accept niceness coins. While this is true, they eat your coins and the only way to get the sex out of them is to hit them and/or tip them over.

I'd go the Warrant in Detinue route instead of any of those suggestions.

Also, the OP is almost certainly a woman, too - that's why the issue is over borrowed clothes - so your last paragraph is totally bizarre.

Exactly. $500 worth of three year old clothes, maybe $50 in replacement value, not worth it. And if you never see this person again, it was money well spent.

How is my last paragraph bizarre? Why do you assume the OP is a certain gender/sex? I make no assumption on the gender or sex. The only assumption I made is that the OP is sexually attracted to women. Just because someone is sexually attracted to women does not mean they're a man. Though, admittedly, I should not have assumed the OP was sexually attracted to the friend. But that is the only assumption I made, so really that's all anyone should be miffed about.

You obviously can't read.

Borrowed clothes is a hint. Altho this day and age I suppose males and females could wear the same shit.

Call her and pretend to be a clothing donation charity and ask if she has any items she'd like to donate for a scheduled pick up. Hopefully she'll say yes and on the day of the said scheduled pick up, drive by and swipe the loot. That's right. Take it. Maybe some of your stuff will be in the donation.

Does she have a boyfriend? Sleep with him a couple of times then make sure she finds out about it. She won't want your clothes anymore. If you don't want to sleep with him, find a way to leave condoms and your underwear in has car. It will be hard for him to explain it to her.

Ilike the idea of undies and condoms. But you could just tell her you will fuck her up - that often works with assholes like her. Make sure no one is within ear shot. Tell you you want your things back in perfect shape by friday or you will fuck her up so she cannot walk right anymore. Dont elaborate.

today you can't waste taxpayers money in small claims court. and $500 is still the "limit" another is "2,000"

yesterday. the judge would say you have a legal responsibility to watch your own money, let it be a lesson cheaply learned

adjusted to how much the courts have been costing my ass don't use the courts unless it's $20,000 or higher

Show up at her house...have some guts...roll up there and say you want your stuff. Then if she refuses and calls the cops they'll settle it in your favor and make her give you your shit back.

If you see her outside wearing your clothes, get some friends to help chase her down, remove your clothing from her body, and leave her naked tied to a tree with some honey smeared on her to attract insects. Don't rape her though.

Other than combat and survival in the wilderness, men do not borrow clothes from one another...homosexuals aside. OP and the culprit are both female.

I bought a house and had girlfriend move in. Soon afterwards, she stopped paying rent and utilities. In the end, a little over a year went by and I finally kicked her out with her owing me short of $5000. I considered it as have a extremely overpriced "hooker" during that time because any effort to get back what was due would have cut into that figure and so I let it go.

$500 is not very much to cut loose. Consider it a hard life lesson and move on. Some people are worthless and not worth your effort to be friends.

You are not getting your stuff back face that fact. Its not worth and legal remedy. If she owns a vehicle you might consider vandalizing it. Fox urine injected into the window seals and down the front vents or just airplane glue all over the hood will cost her her deductible and her rates will go up - that should cost in the thousands when all is said and done.

If you want something a little different you could slash her tires but that is more likely to get you caught. If you know where she lives you can of course mess with that area - Id consider fox urine under the door in volume with aquarium tubing. Superglue in door locks is a nice touch.

Anyway dont get too stressed out about it she is just no class bitch right? I definitely would not sleep with anyone she is fucking as she sounds like the type to have STD's

you'd be lucky if a small claims court would take the case, and you'd need proof of ownership of the clothing

nothing. its' your legal duty to keep your hand on your wallet and not use the public's money to solve your minor problems of having been "overly trusting".

HOW ABOUT THIS QUESTION:

i had a crazy family member addicted to "clothing drives". continually bought clothes that didn't fit and then continually harassed me to give these same clothes to some clothing drive. continually washed (their) clothes, daily, to accelerate the need for putting them on the curb. (not mine i did my own)

i had very few clothes to wear - most were bought for someone else - probably to spite me. after throwing many away i still have a ton of them "to deal with".

--------------------

how do i recover my money from china for selling clothing to a crazy person who should not be buying clothing "on behalf of others", for enabling an abusive person to do such a thing for years ??

should it be the clothing company, the clothing recipients (illegal mexicans in the area getting free clothes), or THE COURTS for changing family law making it nearly impossible for adults to put a check and balance on what others were doing with (family) money?

hmmm? how about that case. it's several thousand dollars and abuse over many years

oh shit in fact i'd always be teased at school for wearing tight shorts that didn't fit. i almost forgot that part.
