Vehicle Gun Racks Legal in VA?

I was wondering if I'm allowed to carry a rifle or shotgun in the cabin of a truck in a gun rack in Virginia?

Some things to consider:

I don't have a concealed carry permit.

VA law now allows for the carrying of a handgun by non concealed carry permit holders within the vehicle cabin, as long as the handgun is inside a secured compartment (i.e. glove compartment or center console). This law only specifically mentions handguns and Im sure doesn't apply to rifles and shotguns, but that doesn't mean there arent other statutes for rifles and shotguns.

Is there any law that specifically bans rifles/shotguns within the cabin and reach of the driver?

Open carry of rifles and shotguns is allowed so long as the magazine of a rifle holds less than 20 rounds and and 7 rounds for a shotgun. Would this law allow the gun rack or not?

Would getting a concealed carry permit make the whole issue a moot point?

This is the type of rack I'm considering, just not too sure about the legality. Can anyone help me out, or does anyone else routinely carry a rifle in their vehicle themselves?

You can if the ammunition is separate and there is a locking mechanism on the rack. Would not have one around fairfax, its asking for theft/unnecessary explanation to police and too many restrictions where you can park ie malls ect.

Don't know if it is legal or not, but this time of the year in the Shenandoah Valley most of the pickups have racks with rifles in them. It is hunting season.

As long as they are not concealed, you can mount them - it falls within the boundaries of "open carry". If you want a solid answer from people other than the illiterate asswipes on FFU, I would suggest you ask VCDL or consult with a lawyer if you don't believe me.

Deer season doesn't really start up till November

This is what I thought too concerning the open carry, I just want to make sure.

I asked FFu to see if anyone could point me in the direction of a definitive "No" or "Yes" within the law about long guns in cars.

It is legal in Va. to have a gun rack with open carry guns in them. We had them 30 years plus back and no laws have been passed to outlaw that. The guns are openly seen in a rack. As far as being loaded. theres a question ..that was there even 30 years ago. Game Wardens may inquire if you are hunting.. In places that there is limited hunting for example FXCO. If the gun is loaded they may try to constru that you have been poaching. There are poachers in FXCO even today in large wooded area's parks ect. If there had been a gun shot heard they may take you gun to see if it had been recently fired. That and the fact that they will be ripped off if thugs see them is a good reason not to have them in a rack unless your say in the G W. National forest in hunting season with all licenses and tags but that said you can be acused of spotlighting game if its night. It goes on and on. Go ahead put in your rack and your unloaded guns..but they will not be there long in todays world. Oh yes all the places you cant have a gun today..too close to a school. A rifle or shotgun in a locked tool box in the bed is a better idea today, but it can still get ripped.

I'm a hunter but won't have a rack in my car because even if it's just parked in Fairfax. There are assholes who will break into your car and your house if they think there may be guns around. I knew a guy in Arlington whose home was broken into just because he had an NRA sticker on his pickup truck. He didn't even own any guns and the sticker was from the previous owner.

Being a recently retired law enforcement officer, here is your answer. Virginia is an "open carry" state. That means you can carry a firearm as long as it is not concealed. You can carry a firearm concealed if you have a permit.

Therefore, you are able to carry a loaded weapon in public as long as there is not a law telling you that you can not do so. So do your homework. First of all read VA State Code 18.2-308 which explains what is considered concealed. You can search VA State Code on line. There are code sections shortly after 18.2-308 which explains that you cant take a firearm into a church, bar, airport terminal, or a school. You can also looking into the hunting section which says that you can't have a loaded firearm when in hunting areas out of season.

VA State code 15.2-915.2 says that county, city and town jurisdictions can make laws relating to the carrying of loaded firearms illegal. So you will have to research each county to see if they have local laws prohibiting the carrying of loaded weapons outside of the "assault" weapon definitions. Fairfax County never made such a law and you can carry weapons in the open just like your picture. Remember, there has to be a law specifically telling you that you can not do certain things. If there is no law, then you can do it.

In Virginia, you can carry a handgun on your belt (not concealed) or a shotgun slung over your shoulder into any business or down any street and do it legally. As long as it is not a school, bar, airport terminal, church. You can carry it on private property unless the owner or management prohibits you from carrying such a weapon either by signage or verbal explanation. An example is the courthouse where there is signage prohibiting weapons into the facilities.

Now just because you have a right to carry a weapon in the open, does not mean that it is the smart thing to do. Yes, people will call the police on you and the police will respond and confront you. It might not be a pleasant police encounter and remember, the police are just doing their jobs. You wont be criminally charged if you are in the right. But is it really worth the hassle. My suggestion is to get a concealed weapon permit and carry concealed. That way the pubic will not get alarmed and call the police. If they public cant see the weapon, they cant get alarmed.

If you turn up in most Fairfax neighborhoods toting any kind of uncovered fire-arm then you can expect an encounter with the police pretty damn fast

It is far from a social norm to be carrying an uncovered long gun of any form in most of fairfax or to have one on display in your vehicle - because there's no legitimate reason. This is not W.Va, Rio or J'burg

Even though many legitimately and safely CC handguns, OC not a social norm around here and in most parts of the county will flag you immediately and rationally as armed and unusual.

Responsible gun owners keep their tools safe and discrete unless deployed for hunting etc.

If you wave the thing around or clip it up like some kind of trophy then 10:1 you'll get mistaken for some kind of nut job - especially with the recent spate of mass shootings.

This will lead you to a risky encounters and you may very well get shot.

Drive through suburbia with a rifle or shotgun clipped up like some wannabee cop or mercenary, then you will get legitimate calls to law enforcement and you will get hassle.

Social norms are there for a reason

Rule 1 - don't be a dick even if the constitution says you can. See Westboro Baptists...

Years ago, I knew a military family that had just moved to this county. They had bought their son a used pickup that had a gun rack. As a joke the kid went out and bought a toy, plastic gun and put it in the rack. As he was driving to Robinson one day he was stopped by police and almost locked up. Fortunately they lived close enough to the school the dad was coming by and stopped, and cleared it up.

I went to Chantilly back when it first opened. We had gun racks in our trucks. We had guns in the gun racks. No one gave us jazz. They weren't AR style of course. Just bolt or lever action. I'm going to put a few MAGAZINES through my 1911 and a few CLIPS through my M1Garand for the same reason. Unlike a Glock, both were made in in the USA.

They don't. Dispatchers are trained to respond to 911 calls by distinguishing the difference between open carry and "brandishing". So are the cops.

Ex cop doesn't seem to be familiar with procedures. If someone calls the cops and reports someone open carrying and the gun is holstered, cops will not respond. Brandishing is another story.
