if I dont show up in court
Posted by: breen ()

I was pulled over and got a ticket for driving on a suspended license, also no vehicle registration, what happens if I don't show up in court? just a fee, what happens if I don't pay the fee?

Ever been to the Gray Bar Hilton?

Why would you not show up for such a minor offense?

Umm, you will be found guilty in absentia. You will lose your license and a warrant will be issued for your arrest.

Then you will be placed in a very small cell where a nice guy named Roc, Tyrone, or Bubba will show you all the intimate details of a creamy and smeary fudgepacking!!! You will be expected to lick the beater also afterwards!!!!

How long do I have until they issue a warrant?

Nah dude nothing happens here. If you were in CA theyd come arrest you for not paying the ticket.

Here basically you'd be tried in absentia and be found guilty and have a fine and you won't be able to do some stuff like renew your registration (lol which you don;t have anyway) if you don't pay the fine by the deadline. But the deadline will be like 6 months+ from the court day.

If you are moving out of state, just don't even worry about it.

I think you should hire this guy as your lawyer.

If you do I would advise him to ask you for payment up front!

You'd be mostly right if it was a simple speeding ticket, but the OP was driving on a suspended license. They take that seriously. You actually are required to show up to court. You can't pay it online.

They can issue the warrant as soon as it was clear you didn't show up. Now, it isn't a warrant where they will hunt you down and knock down your door to get you, but if you get pulled over or have interaction with the police in the future, they will haul your ass to jail right on the spot.

so I can kind of avoid it as long as I don't get pulled over. What if I have to go to court over something else (civil) if they have a bench warrant and someone tells them can they pick me up in court?

You will go to jail for driving on suspended. ive been in and out of court the last two years and 90% of time these offenders are taken straight to the slammer! U will be fucked in your cell to the point that taking a shit is not an option!

Yes, they can pick you up there on a civil matter if they know you have a warrant out for your arrest (which isn't likely). When was your court date?

New bounty hunters will take the case and collect the $75 pick up fee. The big problem is that the new guys think they get to hog tie you and beat the shit out of you. You could have a civil case against them once you recover and get out of jail.

My court date was July 31 and I was tried in absentia and a fine was accessed of $2500 which I didn't pay, (it was due that day). I have to go to court on Oct 19th for an unlawful detainer. The landlord knows about the revoked license ticket and is threatening to tell the cops that I will be there.

Um, how's that working for you dumbass? Getting pulled over is how you got caught driving on the suspended license to begin with! You deserve a few more tickets...

Yeah, you might want to get that resolved before you go back to the court. However, if you are likely to lose in the civil case, you can not attend that hearing and have a default judgment entered against you. You're really batting a thousand here, champ.

to "clear it up" I would have to pay the $2500 plus probably some fees for not paying it to begin with. so No.

Do you intend to go the rest of your life with this hanging over your head? They will put you on a payment plan if you can't pay it all at once.

So going to jail and getting hit with an even larger fine, getting an arrest history, and getting the upper end on the severity scale for everything possibly for skipping court is the better alternative?

Now that they have the internets and computers and things like that, you'll have this hanging over your head for the rest of your life.

You're the defendant in both criminal and civil cases. Ignoring it just makes it worse. If you can't pay, there's probably some jail time.

You probably cannot afford a lawyer. Maybe you can contact the public defender's office and see if there is any help for you.

Otherwise flip a coin - Canada or Mexico?

"I don't show up in court? just a fee, what happens if I don't pay the fee?"

Pre-pay it. Fairfax is a money hungry bitch and will harass you legally to get the money: or seize your belongings or report you to credit agencies for fees you didn't even owe. I wish i could tell you otherwise.

If the ticket says you have to appear, appear. If something comes up that makes appearing impossible you must call the Court Clerk and reschedule ASAP, before the trial occurs.

If you do not you will very probably be ruled against in absence. Yes they can do that: and they can abuse it.

------------------------
btw: if Fairfax Courts owe YOU money they skip court, delay trials, and they win in absentia instead of loosing the mother fucking bastards. don't you try it. let it be a warning to you what is to come with these people.
