My friend just got convicted of DUI Involuntary Manslaughter and Maiming

My friend had a DUI crash last year that killed one person and seriously injured a second person. My friend was definitely at fault (blew a red light) and definitely drunk. I was wondering what kind of jail time can be expected from these charges. Sentencing is in June.

They have every right to voice their opinion. I was simply asking for info. I assumed (wrongly) that this board was different than Off Topic where I expect drama and mayhem. My bad.

My friend (and yes he is still my friend) knows full well he has taken someone's lfe and ruined another. He also knows he will be paying for this for the rest of his life both financially and psychologically. However it was a tragic accident. I dont think he got in his car that night and said "im gonna get wasted and go kill someone with my car". I dont even drink alcohol so I dont even know how you make the decision to drive drunk.

These fucktards in this thread make it sound like I went out drinking with the guy, got him wasted, and put him behind the wheel and now I think he should get off easy. Nothing could be more incorrect. I wasnt even in VA when this happened and I think he deserves time in jail. The financial burden he will have to deal with will come later.

But youre right, I should have expected the mental midgets of FX Underground to pounce!

Drunk-driving is a fucked-up situation. We all know it's wrong, we all hate it, but based on my experience, the impairment of alcohol begins when you try decide whether or not you can drive.

Obviously, a drunk is less responsible, in every sense, but that won't be taken into account in court. The mindset is that "we need to make an example of this person" so that maybe it'll stick with someone else. Our "justice" system could give a fuck less about justice... Justice is is an abstract ideal anyway, since the only "just" thing would be to fix the damage caused, and that's generally impossible. Rehabilitation isn't really the goal either, since we all know that the offender is much more likely to come out of prison more screwed up and dangerous than when they went in.

It's about making those who watch feel that there's been some sort of "eye for an eye"... call it retribution if you like, because I don't have another word for it.

What he did was unforgivable, in any sense, and I'm sure he knows that better than most. The best of the offenders really do get punished the worst. They have the toughest time in prison, and they have to live with guilt. Those that are unredeemable sail through the system and walk away relatively unscathed.

I don't have answers or solutions for any of it. His victims and their families have my sympathy. He and his family has my sympathy. I'm not going to guess what his sentence will be, since that's mostly luck. It depends on his priors, the Judge, the Prosecutor, his Lawyer, the locale, and often on twelve individuals who, as often as not, aren't really even focused on the entire trial... and even if those factors are known, there's no way to tell what kind of mood they'll be in that day, or which way the political winds will be blowing at that moment.

The one thing that makes me feel a bit better about not having any answers is that I realize that the courts don't have any answers, either. Just the same, everyone feels like they have to do something... anything.

At the very least, justice should be consistant, and I think we all know better than to expect that.

My prayers go to everyone involved in and affected by this horrible tragedy.

I think you already got yr answer but in case you didnt, anywhere from 6 to 18 months is avg. If they REALLY fucked up and pissed the judge off it could be as long as 60 months I guess...............but if the fatality wasnt in the paper that much (i.e. if we all have forgotten about it) then that's prolly not gonna be the case.

Stabitha has been a asshole to most on this forum. He is probably jobless, lives in the basement and until he gets off his ass he is going to be a pissed off loser. Maybe joining the armed forces would help make a man outta him but he is too chicken shit. He got caught with his pants down.

Yeah, im just waiting for mom to make my breakfast (got up early today!) and finish my laundry before I head over to get my SNAP card and unemployment check. Then I think Im going to join up with some Occupy friends I have and we are going to sit around and bitch.

A big factor will be his BAC.

If he/she was .15 to .30 minimum 5yrs. no good time plus 5yrs. supervised probation which is almost as bad as prison depending on PO.

From .08 to .14, 2 to 5 with some suspended for good behavior. Still at least 3 additional yrs. supervised probation.

The warden will hand him a bible and tell him "salvation lies within, but your ass belongs to me"

The warden will also tell him if he's not obedient he will cast him down with the sodomites.

He was .18 so he's going bye bye for awhile I suspect. Oh well, he did it to himself. Worse then the prison sentence will be the life sentence of knowing his stupidity took someone's life.

10 years on the DUI Manslaughter and 4 years on the Maiming. To run concurrently....so 10 years.

No pokey visit. He's in jail nowhere near me. We talked on the phone a couple times.

He is in the bighouse with real criminals just like him. The difference is he is not made for this environment of predators who will fuck him up if he is too timid and scared. They will take his lunch and maybe his virginity. Dont drink and drive people. You dont want to go to a Virginia state prison. They are hell.
