I know we are in Fairfax, but does anyone know what the fuck happened with that kid getting shot to death? How many shots were fired? The kid apparently lived two houses down. Was he that wasted that he walked in someone elses door? Wasnt the front door locked? Something doesnt smell right.

"Caleb Gordley wanted to go to a party Saturday night. But the 16-year-old was grounded because he hadn’t cleaned his room. So he decided he’d sneak out of his Loudoun County house to be with his friends.

When he left the party at about 2 a.m., Caleb needed to sneak home. His friends dropped him off and helped hoist him through a back window. But Cabeb had been drinking and had gone to the wrong house. The brick homes on his street are similar, and Caleb was two doors down from his own.

The homeowner heard his burglar alarm sound, grabbed his gun and went to investigate. When the two met on the stairs inside the house, the man said he told the teen to leave and fired a warning shot, according to a law enforcement official with knowledge of the investigation.

Caleb didn’t stop, and the homeowner fired again, striking and killing the teen, the official said."

He came in through a window, alarm went off, owner finds him going up the stair case toward the bedroom, Owner unloads on him. Case Closed.

I knew a former construction boss who back in the early 80's went into the wrong house drunk, thinking it was his. He ended up passed out on the couch, woke up to a kid yelling to his parents that a strange man was sleeping on the couch. He was lucky that he was not shot.
I sounds crazy, but It's a true story. I feel bad for all that were involved.

Thanks for the info. His friends are total dumbasses for hoisting him in the wrong fucking house. All 3 of them were that wasted? Homeowner probably did the right thing but its a damb shame he couldnt have fired a non lethal shot to the leg.

Jesus, you seem kind of stupid. Why don't you read an article about what happened? The internet is your friend. In case you have trouble finding the Post online, the neighbor fired a warning shot first.

Same theme as the IHOP kid, Travon Martin, etc.

1. Unsupervised teenager wandering about drunked/stoned/etc long after their irresponsible parents should have called lights out
2. Commits second crime - typically property
3. Encounters sober and armed citizen not willing to look the other way
4. Ignores lawful order by citizen to stop/leave/etc and continues toward armed citizen
5. Citizen shoots - teenager dead

Tragedy could have been avoided by:

1. Not drinking
2. Not wandering around in the dead night
3. Stopping when the alarm went off
4. Stopping when the homeowner confronted him

This kid had lots of chances to avoid this. It's very, very sad, but it's no one's fault but the kids.

You don't have to obey a dispatcher's suggestion.

He may be charged with manslaughter as many are in similar unintentional killings but he won't be convicted on the basis that he didn't heed a dispatcher's advice.

And here's why: A Castle Doctrine (also known as a Castle Law or a Defense of Habitation Law) is an American legal doctrine that designates a person's abode (or, in some states, any place legally occupied, such as a car or place of work) as a place in which the person has certain protections and immunities and may in certain circumstances use force, up to and including deadly force, to defend against an intruder without becoming liable to prosecution.[1] Typically deadly force is considered justified, and a defense of justifiable homicide applicable, in cases "when the actor reasonably fears imminent peril of death or serious bodily harm to himself or another".[1] The doctrine is not a defined law that can be invoked, but a set of principles which is incorporated in some form in the law of most states.

230 am and an intruder in coming up the stairs where the guy and his family sleep. Guy encounters intruder on the stairs. There is no way the homeowner knows the intruders intentions. What if the intruder had bad intentions and shot the homeowner, then continued to walk past the dead corpse and murder the rest of the family. The homewoner eliminated any chance of that from happening.

Agree, It really sucks and is a shitty deal. put yourself in the homeowners situation. I don't know anyone that would have not pulled the trigger. It's a fucked up deal, I feel bad for everyone involved.
I would have shot also and I would have felt like shit finding out why the kid was in my house.
It's just a fucked up situation.

Don't think Castle Doctrine specifically applies in VA. As I recall there was a bill proposed last session but it didn't go through for whatever reason.

That said, there are similar general principles which would apply with respect to self defense within one's home.

This is the VA specific statute....seems pretty clear to me!

§ 18.2-91.1. Use of physical force, including deadly force, against an intruder; justified self-defense.

Any person who lawfully occupies a dwelling is justified in using any degree of physical force, including deadly physical force, against another person when the other person has unlawfully entered the dwelling, having committed an overt act toward the occupant or another person in the dwelling, and the occupant reasonably believes he or another person in the dwelling is in imminent danger of bodily injury.

Any occupant of a dwelling using physical force, including deadly physical force, as provided in this section shall be immune from civil liability for injuries or death of the other person who has unlawfully entered the dwelling that results from the use of such force.

Statute shows exactly what elements are needed ...

He had to have commmited an overt act...So the question is if his failure to stop when warned meets this or did he do something else that isnt in the paper ?

Occupant has to believe he or other is in IMMINENT danger of (not death) but bodily injury...this is where he should have listened to he dispatcher, chances are good he had a duty to retreat, if he had been in the room no retreat available,no problem...

Castle Doctrine generally goes beyond the criminal statutes to also extend to the civil side. And it's usually done in a stronger form which specifically prohibits criminal and civil prosecution in such cases. That is, if the situation meets the circumstances for use of deadly force, then there are no further legal questions/charges to answer.

There also is no specific "duty to retreat" in VA as there is in some states.

My bedroom door is on one side of the upstairs and my kids' bedrooms are on the other side of the staircase, separated by a guest room and laundry.

No way would I yell for them to, "Just lock your door," and then pretend they're going to be OK while an unknown number of strangers have invaded my home. No way.

Homeowner does not have to follow the directions of the 911 operator. What a dispatcher says is not law.

It doesn't matter now if people on the INTERNET say the guy is a pantywearing/pantysniffing, white power gun nut or a monk- this shooter only has to defend himself from the facts of an intruder at 2:30AM. And not one that mistakenly came thru the front door, but one who mistakenly came thru the BACK FUCKING WINDOW.

the homeowner did nothing wrong. He told the teen he was armed and asked him to leave numerous times. He only shot the teen when the teen was at the bedroom door where his wife and son were hiding

Yeah dickwad, happens all the time... I can't count on both hands the number of times I crawled thru the window of the wrong house when I was pissfaced.

Christopher Paul Silga was drunk and asleep on a couch cuddling a teddy bear.

The problem? He was in the house of a couple he did not know, and who did not know him.

The Mississippi Press reports that a couple was shocked when they awoke to a drunken man they had never met asleep on their couch, snuggling with a teddy bear.
At this point, it's a toss up between which is more embarrassing... a grown man sleeping with a teddy bear or doing it while passed out on someone else's couch?

According to police, Sigla apparently thought he was at his girlfriend's home, but had in fact walked through the front door of the couple's home and then gone to sleep.

Sigla, 34, was charged with trespassing and driving under the influence (after an attempted getaway).

Reports showed that the homeowners called authorities after asking Silga who he was and then pushing him out of the front door and down the steps.

The couple told authorities that the stranger snoozing on their couch was "very intoxicated" and appeared "spaced out."

It turns out he was off by about 20 miles.

State police say a homeowner in rural Erie County town of Newstead woke up around 4:30 a.m. Saturday and found a stranger sleeping on his couch. He was unable to wake up the stranger, so his wife called 911. When troopers arrived, they found the very intoxicated man still sleeping on the couch.

Troopers say the man told him he thought he was at a friend's house on Grand Island, 20 miles west of Newstead.

The man was charged with criminal trespass and issued an appearance ticket for Newstead Town Court.

Just like on TV right? Youre a moron. The first thing you learn in weapons training is aim for a large target i.e. center of body. Im just suprised he only shot him once. Should have emptied the magazine on him.

He probably wet his pants he was so scared. He was not a threat--no way. Probably realized he was in the wrong place and tried to get out.

1.Have you seen the pictures in the Post of the BACK of the houses? He went in the back window. The back of the houses are nothing alike-one has a screen porch and one does not. Also, the driveways on the front are on different sides of the house.
2.How do you know that the friends are telling the truth?
3.Maybe there were other people in the house at the time. If I had kids asleep in a bedroom, I would not lock myself in my bedroom if there were an intruder.

There are a lot of unanswered questions. I would not want to be the shooter--nor would I want to be the family that hosted the party where they were drinking.

What's NCIS? Personally I have found that the Louisville slugger works best. Used one years ago to inconvenience to burglers. Ruined their night and the next three years of their life. Will never forget the sound when the bat hits the bone. A bat against a .38 and two dumbasses in one inning. Only one lamp broken when dumbass 2 fell. I just finished reparing and painting the room so didn't feel like shooting them.

If you are being truthful, which you are obviously not, hitting someone hard enough with a bat to hear it hit bone would break skin and cause blood spatter which would be the same result as shooting him.

If your life is in danger, you have a right for self defense. If you hear an intruder in your home, or breaking in, yell out that you have a gun and to freeze. If they run out of the door, do not follow them. If however, they threaten you, or come closer, even when you have told them you have a gun, you have a right to defend yourself

No holes in the wall. Only pistol I have ever owned is a Remington M1911 and the rounds were .45acp hardballs. Sparse furniture after renovation but who cares.
There was some blood and few broken teeth.

If the danger has passed, (the intruder may not be alone) put the gun away in a secure place, unloaded. The officers that respond to your call may want to retrieve the weapon for evidence. The worst thing you can do is approach the police holding a gun. When the police arrive, simply tell them you you fired your gun out of fear for your life. Do NOT provide any additional details, just say "I shot out of fear for my life." Once you get the story straight with your attorney, then and ONLY then do you want to give the police details.
