Just got outa Fairfax ADC for a dwi at 7:00a.m. Those folks are slow to process paperwork. One guy slowed the whole process down by fighting with the deputies. When they got done with him his body was completely limp. I hope he lives. Will this be considered a first offense since none of my many other dwi's were in Virginia and the last one was in minnesota just slightly over 5yrs. ago. I'm gonna have a couple J.D. double shots because I feel horrible and then take my wife's car up to town and get some advil, a hamburger, and a six pack. I'll check back in when I come home. I could really use some loving support right now. Wifey is pissed.

To be considered a predicate offense in VA, any other states statutes that you were convicted under must be "substantially similar" to VA's 18.2-266. When you say "many others" that is a concern. Were you charged with a subsequent offense? Should say that plainly on the warrant. 3rd or more would be a felony. That being said, most other states statutes are not substantially similar to VA's. Recommend you call my buddy Jim Freeman if you are in Fairfax. Sounds like you NEED someone top notch that could give you the best shot at reducing any potential jail time.

The first dwi was over 5 years ago so you should be fine. However what was your BAL? .above 1.2 is something you need to be concerned and get an attorney, preferably Nick Balland in arlington. He knows all tge prosecutors and judges. It will cost you 5 thousand dollars but he will get it ruduced to recklass

I have some concerns asout someone posting as "attorney" who uses BAL when it is BAC commonly. Plus, 1.2? VA has mandatory jail time at .15 or greater, 1.2 you would be dead. Again, your priors with you stating "many" are more of a concern than your BAC, after 3 priors, BAC isn't even considered as enhanced punishment. If you are in Fairfax, call Freeman. I know Nick too, no disrespect to him, he wouldn't charge you 5K either, but it's best to stick with a local guy for your jurisdiction. As a lawyer, that's who I would call if I were you if I got popped in Ffx.

I was just about to take those shots of whiskey and just started crying thinking about how selfish I have been to my wife and kids. Then I realized I can't drive for a week. I looked at all my paperwork and it is listed as a 1st offense with a .087 bac. They also took blood but I don't guess it will change the situation. I will get what I deserve probably. Oh well, all I can do is be a better husband and father. I rarely drink and not too much when I do, but I must be some type of alcoholic. I don't know why I never saw this before. I hope I don't sluff this off and drink again because I feel a peace that I never felt before. Thanks for the replies.

Good luck dude, Fairfax County is going to charge you LOTS of money. Hope you have access to AT LEAST 5-7 grand (for court fines, fees+ lawyer). If not....get a cash advance on a credit card, or worse case some payday loans or a car title loan if you have to. You can always file BK once everything blows over.

In the meantime, get a <50cc or electric scooter like this one to roll around town with. Don't drive anymore please!!! If you get popped again its JAILTIME!!

I did not use the knife and only implied i had one. I only got 80 dollars and it was first offense. I dont want sympathy but fair is fair. He could have killed someone just like the state said I could have. Prison was a big wake up call. It made me do things I never thought I was capable of. I was in at least 20 fistfights which some I won and some I lost. My advice is if your facing prison you better start working out and learn martial arts and boxing

Man, that was close, just got back from picking up a bottle of Jack and almost got pulled over. The damn cop was in the ABC parking lot and he pulled out behind me as I left. Good thing the car is registered to my wife so he had no way of knowing that I don't have a license. On another note, rootbeer and Jack is quit good together.

I told you you need to workout and stay healthy and learn to fight or you are going to a girlfriend to many niggers. I had to literlly fight for my life several occassians. I hit one nigger so hard his tooth was lodged in between my knuckles. He was out for 5 minutes. Prison aint no fun. Wise up
