First Offense DWI .14 bac fairfax county

Hello Everyone,
I just got a DWI last weekend in fairfax county, I blew a .14 bac....
At this point I'm really scared and need some advise...anyway I can get out of this? reduced to a plea bargin? will I have any jail time? I'll get whitestone to be my lawyer.... do you recommed VASAP before my court date? driving defense course?

don't use hunter whitestone! he is literally a bumbling idiot. He'll hardly remember your name each time he meets you, let alone your case, and he took my DWI to trial with no arguments or ANYTHING prepared, no papers to show the judge and no research to support any of the crap he was saying. The judge was sitting there scratching her head, like 'what the hell are you wasting my time for' and I don't blame her! Whitestone Sr is supposed to be awesome though.

Yes- inroll in ASAP before your court date, it shows you are taking pro-active measures. Its also in your favor that your BAC was a .14- the penalties are much harsher if you blow a .15 or higher.

The scariest thing you'll go through is not knowing. Your lawyer really can't give you an idea of what will happen because it all depends on the prosecutor. If the prosecutor is not willing to negotiate a deal, then you will go before the judge.

Also- you only need to enroll in driving school if your driving record has positive points already on there. Your lawyer should be able to advise you on that once you show him your driving record. Good luck, VA is not easy on DWI's.

Definitly enroll in ASAP pre trial. You can call them on your own and ask to "pre enroll". Fairfax ASAP is 703-279-2600. You will have to shell out the $350 (or $400?) at the intake. *** AND THEY DO BREATHALYZE EVERYONE AT INTAKE REGARDLESS OF PRE ENROLLMENT STATUS*** You can have your intake done before the court date and can go to court and show that you are being proactive. Hopefully they will send you away from your intake with a letter showing enrolled in a class. If you do get convicted of the DUI you will lose your license for a year and a restricted license is not something that is automatic. Most of the judges now say "a restricted license will be granted upon ASAP's recommendation". ASAP doesn't recommend ANY restricted license until AFTER you successfully complete their classes. Those classes are 10 weeks too. It is much easier to get to those classes too if you have a license BEFORE the court takes it away.


On another note, Whitestone Sr is good (not Hunter), and so is BR Hicks. For DUI cases i would highly recommend Peter Greenspun or Jim Bitner. Both are awesome attorneys and are very very nice guys. They treat their clients very well, have very preofessional staff and are well respected in the courts.

I had a DUI in March 2003. I refused the breath test at the police station but blew a .011 in the cop's car which is inadmissible.

I got a lawyer for $2500 and he ended up plea bargaining with the DA to not prosecute the refusal (nolle prosequi) and me plead guilty to the DUI. I got 30-day (really 15 days) suspended sentence, a restricted license and VASAP. The VASAP was just 10 classes about 1.5 hours each. They could call me in at any time to get drug/alcohol tested but they never did. I also had to go to 8 AA meetings.

Really it was a slap on the wrist. I have never driven drunk again though!

Just get a lawyer and do what he says. If he says to do VASAP before the trial then do it, otherwise don't worry about it.

Also I'm sure I don't need to tell you this but don't listen to these holier-than-thou idiots on this forum. DUIs happen to everyone. In fact that's what they teach you in the first VASAP class.

You could be right. I was scared out of my mind at the time and just went into defensive mode. I didn't want to give them anymore evidence to use against me. It wasn't a baby DUI - I was 33 at the time.

It all worked out OK. If they prosecuted the refusal then I wouldn't have been able to drive at all. Because of the plea bargain I was able to drive to work and the VASAP classes. Now, five years later, my insurance company doesn't even consider the DUI for my rates (they only look back four years in customers' driving records) and I haven't gotten a single ticket since then. I'm paying the lowest premium possible.

Technically you are wrong. Alcoholism is a disease. Therefore "anyone" can get it like anyone can get cancer.

What does alcoholism have to do with DUI ? Lot's of alcoholics drink at home, or take a cab. Lots of people with DUI's aren't alcoholics.

No, that is a Factual Error. An error in logic.

IF someone held a gun to your head, would you be able to not drink? Maybe, maybe not. There are plenty of Alcoholics who would still drink. Under the same circumstances, there are plenty of drug addicts that would still shoot up. There are plenty of gamblers who would still place a bet. There are plenty of Christians who would not renounce Christ.

Stupid? Yes! But a given? No.

Sure, they can't happen to people who never drink. But nobody likes assholes like that anyway.

But anybody who lives in the real world and occassionaly has a few drinks at a bar can get a DUI.

Okay so I went to my ASAP INTake and blew a .011 They took away my restricted license. Whats going to happen next? They said the judge might give me my restricted license back. But will I get charged with anything else?

seeing this in context, you sound like an alcoholic to me. I wouldn't worry as much about asap as you should be worried about the ADS (Alcohol and Drug Services) intake (I assume they still make substance offenders do this).

The ADS guys' strongest factor in deciding to put you in the program will be your propensity to keep drinking even though harsh consequences are falling on you...

Got one in NY last thanksgiving. Wasn't even buzzed and blew a .9. I got it reduced to reckless. Paid $2200 bucks including fines and got 5 pts on my license. Took the defensive driving online course for $50 bucks and it gave me those 5pts back. Insurance stayed the same.

my son is 19 and he got a dwi i did hire whitestone we go to court oct 23 he has a under age and a drunk in public i dont know what to do we go talk to whitestone on the 9th i hope he will help him

goin to court for my DWI tomorrow ( 2/23/09 ) . I blew a .15 at the station.
thing is , the cop followed me to prince william county before he turned the lights on , no probable cause to pull me over , his reason was that he didnt see my tail lights light up when the speed limit that was posted said " Speed Limit 40 up ahead " , I drive a 5-speed manual transmission car and was downshifting to get to the speed limit , but like I said , not speeding , not swerving , and the cop pulled me over in PW county and took me back to FF county.
this really sucks because my birthday is on 2/24/09 and I'm a single father of three and just dont know what to do if they put me in jail. hopefully they'l give me a few days before I can turn myself in , that way I can get things situated for my kids.

An officer in Virginia can stop you anywhere in the state for a misdemeanor and anywhere in any adjoining state for a felony, as long as the offense took place in their jurisdiction.

You mention "probable cause" for a stop. He only needs reasonable suspicion for a stop. Probable cause is needed for an actual arrest. The threshold for reasonable suspicion is much, much less. People tend to get this term confused, even attorneys.

Speaking of cause, what was the cause of your poor decision making to get behind the wheel being nearly twice the legal limit?

You won't get jail time if you're the sole provider for three children. Not if this is your first offense.

Now. Do your children a favor and start acting like an adult. Show them that it is OK to fuck up as long as they learn from their mistakes and gain the wisdom to realize how immature and selfish their father was when he got drunk and then decided to go for a drive.

Well, if you blew a .15 it is mandatory five days in jail. One year license suspension. ASAP classes. Anywhere between a .15 and a .20 is automatic 5 days. I blew a .20 3 days ago this time last year. I plead guilty and they whisked me away to jail. A lot of it also depends on the prosecutor and the judge you pull. One other thing you have going against you is your BAC was going up and not down. The prosecutors basically throw out the BAC used in the field and use the one at the station. The reason being the ones used in the field are a lot more faulty. Your lawyer can check to see if the license of both the BAC machine and the person who administered it to you had been calibrated and both had their licenses updated/renewed. Hope I caught you in time and good luck. If you do happen to get the 5 days, I can tell you firsthand it is not that bad considering. It will go by fast. Make sure you prepay some money for phone calls when in the DT's.

That's funny. You were dumb enough to blow into the machine after getting busted for your dumbass swerving. Anytime I get pulled over, I refuse the fuckin' field sobriety test, refuse breathalizer, refuse blood test, spend 1 night in jail, license suspended 1 year mandatory, hire a "choffer", beat the case due to a lack of admissable evidence. No increased insurance rates, no DWI felony on record, no probation ( ain't that a bitch ), no piss tests, no meetings, just a loss of license for a year which would happen anyway if convicted of DWI when giving the pigs solid evidence of me being drunk as shit. Just take your penalty for being plucked and move on without a blemish. Be smart, next time don't give in to that bacon grease bullshit or take a cab home, it's much cheaper.

I was in court today, not DUI. Some guy had his DUI case dimissed because the cop didn't show. Cop and defenant had the same last name. Coincidense?

That's great for that guy, but now I'm pissed. I was in court last week for a reckless, and the cop was sick. The judge dismissed 5 people, then called my name and I was so happy, then the judge asked me if I wanted to plead guilty or not guilty. Of course, with no cop, I said "not guilty" and he said, "since this is a misdemeanor, I'm going to continue this until the officer's next court date since he is sick today."

Here I thought it was always dismissed when the cop fails to show for whatever reason.

The only consolation is that this judge was a real dick. He gave one guy 5 days in jail for reckless. I'll be much better off with another judge in 30+ days.

Never hit anything either (accidentally anyway), not even the one time when I could barely keep my eyes open! But I don't drink anymore, so that's all behind me. =P

No. Not just no but hell no. It's not a "could happen to anyone" thing. It's putting other people's lives at risk because you wanted to...whatever. That's sickening. There are few things I'm in favor of zero tolerance for. DUI's are one of them.

Yes I'm chnearged with DUI 1st offense and refusal. I didnt take any field tests and did not blow in any machine. The officer and I spoke at court and I appologized to him. My lawyer came in and said that was smart the officer really appreciated it. My lawyer wants me to enroll early to ASAP before my next court date. The last one was continued. Does anyone know what the outcome might be or the penalties.... fines, etc.

If refusal gets you a year suspended license automatically then that sucks, but if you know you're over the limit then you would have that year without a license and then some.

Is he right?

it doesnt sound right. That's prolly 1 year ON TOP of whatever conviction you get for the DUI so you may end up with two yrs of no license, and whatever the judge gives you
