Parking Citation Bullshit

So I park at the Metro lot at 1 PM on 1/3/06. I come home at 5:15 (I was on a half-day) to find a parking citation.

My state inspection expired on 12/31/06, or some 62 hours previously. And now I've got a ticket.

The greedy bastards want $40 for it and make it oh-so convenient for you to pay, even providing an envelope and a plastic baggie to make sure it doesn't get wet. What a scam. You just know they have hired out to a private company to increase their revenues.

So I'm planning to contest it as I immediately went to have my car inspected, waiting in line an hour and a half.

Problem is, I look on the ticket to see what Fairfax County Code I violated. It says 82-5-26(B), but that is listed as "Parking vehicles without proper license and registration on highways prohibited."

Possibly subsection B clarifies this, but I was clearly not parked on a highway. I was in a Metro lot. Big difference.

I can't find the exact code online and don't want to have to drive out to the government center.

Plus the website they list on the back to get further information about contesting it (www.fairfaxcounty.gov.dta) doesn't even work.

Anyone have any type of experience with this?

I have to file an affidavit to contest it and appear in court, but I'm willing to do it because it's such bullshit.

Got the same ticket except it was for No County Decal. I was going to try to beat it but apparantly since the metro owners allow the police to come on to their property on a regular basis, they are allowed to give tickets as well. Happened to me at Fair Oaks Mall..which clearly isn't a highway. it's more of a parking lot.

Perhaps you can contest it in writing? I did that with a recent DC ticket and haven't heard back from them. Not sure of the outcome yet.

Well, if your state inspection expires on 12/31/06 then I would definitely say you should fight the ticket!

If it expired on 12/31/05 sounds like its your fault then. What is it with people? You sit there and stare at this bright yellow sticker on your dashboard ALL YEAR LONG and still let it expire. Then, when you get a ticket you so richly deserve you want MORE time to take care of it because its "not fair."

Is this how you pay your bills? Your mortgage? If it is I would hate to read your credit report because they aren't going to give you much of this "grace period" you think you deserve either! Thats how things are in life, its either late or its on time. In this case your inspection is either expired or its not expired. There is no "grace period."

I've got news for you, you had 12 months to take care of it and you failed. It's your fault you are delinquent, not Fairfax County's and not Metro's. And just because it says 12/05 that doesn't mean you HAD to have it re-inspected in December, only that it expired on the last day of that month. If December was a particularly busy month for you it could have been taken care of in November if necessary.

Suck it up, pay the ticket, assume some responsibilty in your personal life, and learn from your experiences.

Your reg. was still expired, regardless of whether you parked on a "highway" or not, and that's what you got ticketed for. That's what's going to work against you.

Look, I'm fully aware NOW that the inspection was expired. But no, I don't spend all my time while driving staring at the inspection sticker. I have better things to do.

Besides, the mortgage company sends me a bill in the mail reminding me to that it's due, jackass. Guess you don't have a whole lot going on with your life than waiting around and looking at the calander waiting to give Fairfax County more of your money.

The fact of the matter is that this is an opportunistic money grubbing scheme by Fairfax County to increase revenues at the expense of their citizens.

Why the Hell else did they hire out a private company to do it for them that won't even tell me what the name of their company is when I call them?

What exactly did I do that was so horribly wrong as to cost me $40?

I didn't have my vehicle looked at for ten minutes in a filing station.

You people seem to think that just because some minimum wage making meter maid issues you a ticket, that you are obliged to just bend over and take it.

Let me tell you something: Everytime I've gone to court for a speeding ticket or for some petty bureaucratic bullshit like this and contested it, I've always come out better than if I just took it in the ass like a bitch like you people.

So yeah, I was wrong to not get my vehicle inspected, but the County relies upon choages like you to keep filling their coffers and not standing up for yourself when they do stuff like this.

So keep on taking it in the pooper. Me? I'll fight it. And even if I lose, I'll still know that my place in the inter-galactic scheme of things does not reside with the weak and worthless punks who suck it up from The Man whenever he says "Boo".

And to whoever supplied the definition for "highway", thanks. I knew it was a stretch, but you try everything you can.

I'm sure I can persuade the judge to see it my way when I talk to him.

What "scheme?" It's the friggin' law! Not understanding it doesn't make you immune from it. You can spend your day at court if you want to. I'm sure the judge will tell you exactly what everyone on this board has - you are at fault. With any luck he will tack on a court fee on top of it because you are being a dick.

Almost any time you go to court in person for a sticker violation, and show compliance, the charge is dismissed.

I've had it happen to me MANY times. Of course, I'm usually showing up for something else, as well, that does NOT get dismissed or gets continued, but those sticker charges are gone by the time that stuff goes down.

Yeah, I once got a ticket because my new registration stickers hadn't arrived yet and I forgot to keep a copy of the web transaction in my car. I brought proof that I had in fact renewed on time to court, but never had to present it. The judge simply asked if I was currently in compliance and I showed the officer the registration card. Our conversation was so short that the fact that I had renewed on time never even came up.

Thanks. That's what I suspected.

I immediately went to my local service station, waited in line for 1 1/2 hours, and got my car inspected right after I got the ticket.

And it is worth my time to go to court for the sheer principal of the thing.

I once got issued a ticket by a Virginia State Police officer while driving a company vehicle on 3/1 at 12 noon. The inspection expired on midnight 2/28.

I went to court and won that one as well.

And don't get me wrong, I'm all about obeying the law. But the law must be reasonable and to take into account mitigating circumstances. And that's what judges are there to decide.

And I've already penciled in for next year when my inspection is due so that it doesn't happen again.

Well, actually you didn't "win" anything. You had to go to court and the state still "won" because you complied with law. Just because a case is dismissed as complied with law that doesn't mean you "won" anything.

And as to your earlier message, when did Nazi Germany become involved in your ignorance?

That's such a favorite tactic of liberals to resort to name calling and bring up Hitler and Nazis whenever the government enforces a law upon them.

If you fancy living in a society where there are no laws to be enforced perhaps you should move to one of those progressive countries where its every man for himself. I think the Nazi reference has more to do with the fact that your life is in such disarray that you can't figure out how to get your fucking safety inspection done. Instead of taking responsibility for your own mistake you compare Fairfax County government to the greatest genocidal regime in the history of mankind. Pay the registration online at dmvnow.com. Takes less than 5 minutes for the computer retarded and less if you know how to actually follow directions. You print the little receipt at the end and wait about a week and get your new registration in the mail along with the stickers. When you actually receive it, take note that the renewal date will say 12/31/05 and take it to court and tell the judge that who ever wrote the ticket must be on crack because your registration was current at the time. ~THE END~

Also - you mention that a private company is contracted out to do the parking tickets. The only thing that the private company does is the processing of the tickets. Fairfax County Traffic Enforcement Officers (not cops, but close) are the ones who actually issue the citations.

Might want to do a bit of research next time before you jump to conclusions.

I think that all of you guys are too radical about things.

On principle, contest it if you feel that you were wronged or make the payment if you have a conscience about the ticket.

OR being more economically-minded,

Contest it if you are in a tight spot financially, and then learn from your mistake--or if $40 is just a drop in the bucket, pay it online (...and then learn from your mistake).

We're not Nazis and nobody here deserves to be skinned or gassed. The purpose of this thread, I assumed, was just to figure out what you can and cannot get away with; there's nothing at all wrong with that, because laws were never meant to be absolute. Stick to your guns and put a feather in your cap for either being a loyal citizen, or nobody's biotch.

Years ago we had to go and spend an entire day down in D.C. to contest a ticket, but in the end we had to go home and do it in writing, because the court was absolutely jam packed. We won.

This county is all about raking in the money aka theft. I just moved to Reston from Sterling recently and my roomie has three parking tickets within a 3 week period. All from the same "officer". There are brush covering all the signs so I hope you spend time walking up and down where you park looking for bust stop /no parking etc. signs. Oh and also they let cops kill people left http://goo.gl/3Uy6a and right http://goo.gl/UhXIt.
