James Hawkins Receives the Death Penalty

MEMPHIS, Tenn. - The man convicted of killing his estranged girlfriend, then forcing their young daughter to help dismember and dispose of the body, has been sentenced to death.
33-year old James Hawkins was found guilty Friday for first degree murder in the death of Charlene Gaither. He was also found guilty of filing a false report for reporting Gaither missing, and abuse of a corpse for the dismemberment of Gaither's body. It took a jury of seven women and five men just under 2 hours to deliver their verdict.
The sentence was delivered Saturday evening by the jury. Hawkins remained emotionless as he learned his fate.
His daughter with Gaither, who was 12-years old at the time, testified that she was forced to help cut up and dispose of the body. She also testified that she was repeatedly raped by Hawkins, and was threatened by him if she reported the abuse. Defense attorneys argued that the daughter killed her mother, and Hawkins was only covering up the crime to protect his daughter.
Hawkins is still awaiting trial on charges of child rape.
