Federal money cannot be spent (directly and legally anyway).
State money can be given that choice by voters of the state through their reps.
Is there something confusing about that?
Also, because something is in 'Romneycare' doesn't mean that Romney put it there if that's what you're going for. The law was not created by him alone and has been changed in many ways since.

Employer size requirements and penalties were smaller.
Employers with 10 or more employees were required to provide insurance under Masscare. The penalties were $295 per employee.
