What is the stupidest thing you homeowners' association done?

Mine sent out a newsletter saying cats should be kept indoors or on leashes when out. The newsletter item also said to call the Animal Welfare people to come get any off leash cats because there are leash laws for cats.

I lived at a place that sent welders out to fabricate a wrought iron railing on the rear patio of a ground floor unit. I was supposed to go in the front of the building where the patio was recessed from the ground. Instead some handicapped dude was basically locked out of his home because he used the sliding glass door entrance.

My neighborhood has several stray cats living in the area. I have a couple of asshole neighbors who feed them, making the problem worse.

I don't have a problem with cats, but I hate strays. It ain't good for the cats, either, I see them get mangy or suffer from poor health. One of the cats around here went deaf from some kind of infection, and you could sneak right up on her and freak her out. Eventually, somebody took the cat in and got it to the vet, but most of them just stay in the woods.

My HOA passed a rule prohbiting kids from playing in the parking lot, which is on a dead end. Something about protecting the HOA from lawsuits. Since it's a dead end, there's no traffic, so it was stupid. Now the brats all play on the sidewalks, because there is no open space at all. Even towns and counties don't pass rules prohibiting play on the streets, only an HOA is pussy enough to do that.

HOAs are run by retired hags who want to turn your home into part of their little dollhouse community, control freaks with no jobs who like to walk around with clipboards all digital cameras. Legalizing HOAs: worst idea ever.

For all the grief people have about HOA's (and admitted, much is probably legit), you really just have to go to some neighborhoods without them to realize it's often a necessary evil.

I'd rather deal with my HOA than watch my neighborhood gradually decline over 20 years to where I'm out hundreds of thousands of dollars in lost property value.

We can play 'name your favorite example' now if you want... =)

My HOA denied me any financial assistance when a tree on HOA property fell onto my house, causing tens of thousands of dollars in damages. AND they refuse to pay for trees on their property to be removed, even though they are threatening to fall again. The trees, that is. Despite me paying fees to them, I see nothing happen from them other than the neighborhood "block party" and the two times in the spring when they rent a large projector and show a movie outside. And those events supposedly cost $1500...

Yeah, we have these things called "counties" and "cities" which serve the purpose of an HOA without getting up in your face about how you paint your front door.

THe problem of decline is not because you didn't have an HOA, it's because of economic and political forces that ANY neighborhood is subject to, even with an HOA. They can't fine you to make you cut your grass if you don't have any money.

The first two have boats, trailers, carpet cleaning vans and all sorts of trashed yards and weird facades, while the Franklin neighborhoods have a parking district, block watch, well kept homes and yards - AND much higher property values.

Of course if you're a bum who doesn't like HOAs, feel free to buy in Chantilly Farm.

HOAs sometimes get on a power trip and overstep their authority, but overall I prefer one over the alternative.

This is America where the people are free, not everything else.(food, health care, housing...) I hate those Nazi neighborhoods with all their rules. I love my flag, cat, car on grass, firewood. The socialist should be deported with their clip boards up their ass.

Has anyone stood up to their HOA? What are the consequences for simply telling them to get bent? Can they pursue any kind of legal action?

When you buy a house in a HOA'd neighborhood you have to sign an agreement to all their rules. If you blow them off they will fine you and eventually take legal action against you. The most extreme case is you lose your house.

If you really have a problem with them your options are limited, but of course you can always sue.

If that GRASS bothers you that much you need help. Mide your own business, don't look at it. If you have a real problem call 911. Zoning will give them a green sticker for not cutting the grass, they have nothing better to do then harrass citizens.

With most HOAs you take the good with the bad. While some will hassle you about setting trash cans out early they also serve a good purpose. I have seen them cite residents for parking cars on the grass, putting up signs advertising Avon, multi family homes and cars with no Virginia plates. To me it is a tradeoff, I keep my place clean and dont mind the occasional hassle for something minor. In exchange I get to live in a clean neighborhood where working on cars and running a dog kennel is not allowed.

I have relatives that live in southwest Virginia where no one has ever heard of a HOA. They have had neighbors run junk yards and hotels out of a home. All it took was a few bucks to each county supervisor to get it zoned from residential to commercial. Then not a thing you can do about it.

They are actually the lowest form of local government. It's Federal - State - County and/or City - HOA.

For example, if you refuse to pay your dues long enough, they can put a lien against your house and then're you f***ed.

That lien won't mean jack shit until they go to sell their house. Then they simply have to pay off the lien, which probably won't be to difficult relative to the selling price of the home.

Technically, if a tree falls on your house it is an act of God and your problem.


But, all you have to do is send the HOA a letter telling them the trees pose a danger and they should be looked at by an arborist. Then the respocibility will be on the HOA should the trees fall.

A tree fell on my wifes car and my HOA would not even provide me with a replacement parking sticker. I had to "illegally" take my other parking sticker to a printer and make a copy.

I was at an HOA meeting while they were discussing the new rules. I kept saying over and over again "you can not do that! It is a violation of the Virginia Property Owners Association Act". By the third or fourth time I said it, one clown on the Board said "Has anyone here besides you ever heard of the virginia Property Owners Association Act". No one in the room had. The next meeting I bought it up again and again no one believed me. I finally stood up and read it to them and said "See these rules are in violation of the act". They were amazed.

And as far as a lien goes, it does hit your credit report. Tjhe good news is that unless the lien is re-filed in 2 or 3 years or something - it just goes away.

Oh and my HOA restricts parking in handicap spasces to cars with handicap plates issued by the Virginia DMV. The rules say they can tow out of state handicap plated cars who use the spaces.

Lol, good for you and why do you see a need to come here and complain about HOAs? I've bought in both HOA and non-HOA communities and prefer putting up with the rules and dues for the order and increased property value. If you prefer not to, it's yourchoice and a benefit of living in a free country.

Guess I like the cleaner neighborhoods after lving on military bases for a couple of decades...:)

In theory, an HOA seems like a great idea. The key is to research before you buy to see how reasonable the HOA is about the rules and to know what financial shape the HOA is in.

A good friend bought a home in an HOA here in Northern Virginia for all the benefits listed in this thread. It has been a real eye opener for how HOAs can go wrong in practice. This HOA is in Loudoun County. It is one of the HOAs that had money embezzled by that weird guy who was arrested after a high speed chase with the police.

Write a letter to your HOA explaining that the trees are dead/unsafe/etc and ask them to be removed. I would also recommend that you request that they have an arborist assess the area in question. The first tree issue was due to "nature" and now you have put them on notice that there are issues with the trees. You will have a better chance of collecting against the HOA insurance for future issues based on negligence if they have knowledge there is an issue and they do not follow through on your concerns. It is not a guarantee but it may help you in the future.

I have friends who live in neighborhoods with HOA and I have seen the nazi's with their clip boards. Yes, almost exactly what I said. But you have one falsehood. If you put the HOA on notice about a dangerous tree and they fail to act, their insurance company is well with their rights to refuse to cover the damage since it is obvious negligence.

But if you really want to piss off you HOA, find out who their insurance agent and CC them on the letter. The insurance agent will act upon it immediately. Trust me on this.

Actually, a lien is probably the least of what they would do you. Most HOAs have the right of non-judicial foreclosure, meaning they can sell your house out from under you to pay the fines/back owed dues.

My HOA is forcing me to tear down and rebuild my fence and deck for having stain on it. Actually, it's transparent sealant. 80% of the decks and fences, including mine have been stained for more than a decade. Now, they have decided to enforce old bylaws which state clear sealant, no stain. The problem the board members are allowing themselves and their friends to keep their decks and fences stained. I found twelve home owners that said the board told the stain on their decks was okay. How in the world can this HOA get away with this legally? They don't understand that the world has changed since 1992 when these homes were built. CCA pressure-treated wood with dangerous arsenic is no longer used to build decks. The new pressure-treated wood is copper tinted. To remove old stain and sealant from wood, heavy stripping equipment is needed; however this is not recommended on CCA wood due to risk of arsenic poisoning. The EPA suggests the use of an oil-based stain on CCA wood to prevent arsenic contamination. If I have to pay many thousands of dollars to tear down and rebuild a perfectly good deck and fence, I will sue the board if they don't force the rest of the community to remove the stain from their decks and fences as well.

If there has been no enforecment for a lot of years and other homeowners have blatant violations, you might want to consider consulting an attorney on this one. It all depends on the cost you'll incur in having to redo your fence and deck versus declaring war on the HOA.

Also consider the finances of the HOA. If its a small HOA or a HOA with a weak balance sheet, scorched earth may work to your benefit...

fwiw I serve on my community HOA because I when I moved into the area I felt like I wanted to participate in my community of ~900 houses and townhouses. Couple of thoughts from serving 3 years on the board:

1 - Our primary responsibility is to preserve (and enhance?) the value of the homes in the community
2 - People that bitch about having to take down something most of the time haven't read HOA/ARB/community guidelines and are to blame themselves
3 - I'm in a good HOA - I don't agree with everything, but I'd rather make my voice heard to them as opposed to some random online forum. (moral=get involved)
4 - A lot of the horror stories about HOA's out of control are true but they are the exception to the rule

HOA = necessary evil

Sounds like you have a reasonable case. I'd sit down with them and talk about it reasonably first. Explain the situation you have above. Don't bring up the inequality issue yet. See if there's any recourse while keeping it civil.

Then if there isn't, and they stonewall, and you can PROVE the other decks and fences are stained, too, then bring up the unequal application of the rules. Ask how they explain that. Don't get too confrontational yet.

If they still refuse to see reason, then you can consult a lawyer. They are bound to apply the rules equally, and if they don't, they can be in some pretty serious trouble. If the lawyer agrees with you, take it back to them and offer them one last chance to do the right thing before filing the lawsuit.

Yes, get involved, be aware of what's going on. You have more influence at this level of "government" than any other, so USE IT to make everyone's lives better.

Can you power wash your deck to remove the stain? There are chemical cleaners that can be applied to remove most stains and after some time the deck will fade to more appropriate coloring.

The problem is that you asked friends/neighbors their opinions and didn't consult HOA bylaws and apparently failed to go through your ARB in changing the appearance of your deck. Yes, you did change the color ... if you had maintained the color of your deck with a clear sealant, you wouldn't have been in this mess.

I didn't realize you needed heavy stripping equipment. Other than tearing down your deck, what options has your HOA provided? Can you post pics of your deck?

HOA's are good and bad. My HOA help's keep the ghetto dwellers and beaners in line. Otherwise they would throw their trash bags out the front door and have fifteen junk cars in the lot.

I could not agree with your more. The WFCCA is just one example and their focus has nothing to do with HOAs, just look at the representatives that do not belong to a member HOA. Their focus seems to be on individual personal views on what buildings look like, including churches.

The HOA I belong to was, for a long time, run by a board with several members who did not even live in the neighborhood, they were landlords. The rest of them are retired busybodies with nothing to do but walk around with a clipboard while you're at work trying to make a living.

They criticize you for not having as much time as they do to waste on their flowerbeds.

HOAs are garbage. If a problem gets out of hand you can call someone to complain and it will get taken care of.

All these problems listed above are very petty. The fact is I have lived in a neighborhood here with no HOA and had no problems.

Despite the fact that VDOT has reciprocity with all states regarding the recognition of handicap plates, and the Department of Justice mandates this reciporocity between states and foriegn nations, our rules, written by Rees Broom, stated you must have a handicap plate or decal issued by Virginia DMV to use our handicap spaces.

I alerted Rees Broom and my board about this by mail. The Board deemed my letter to be "without substance" and Rees Broom never responded. It took me nearly two years to get this removed from our rules and regulations.

See this is why I HATE the shit for brains people who are on the Boards. This is NOT you primary responcibility. Your PRIMARY responcibility is to act as a fiduciary. That is your number one responcibility and everything else falls a distant 2nd, 3rd, 4th etc.

By doing the above correctly, hopefully protecting values will be an after effect. But thinking you are there to enhance property values and not even considering your fiduciary responciblities is just wrong.

Remember that and your community will be a better place.

Don't like HOAs you have two choices: (1) don't move into the community that has a HOA (you have that choice) and (2) join the HOA yourself and try to make a difference.

I have bought 3 houses (4 if you count the co-op condo). The first is a new townhouse. Parking was limited so I could see why we need the HOA.

The next two houses are single family homes in established upscale neighborhoods. They're old so there's no HOA anymore. We could do whatever we like with our properties. If there's a problem the with upkeep of the properties, the County will intervene.

The question is not whether we need HOAs. It is the neighborhood we choose. If we find a well maintained neighborhood, we wouldn't need HOAs.

The reason why my HOA has no legal authority is because it's a very old neighborhood. The HOA and its constitution was created in 1966. The FFxCo zoning nazis can and do take up the slack. They have this fancy anonymous complaint form on the web where people can report and harass their neighbors.

I got elected to my HOA Board of Directors just so I could counteract any HOA craziness that they came up with. Sure enough, I have had to be the turd in their punchbowl on many occasions.

It is actually a case-study in some form of psychology ... I don't know what branch. But there is one person on the board who takes it as a personal affront anytime he is disagreed with. It is almost comical to watch his tone change as he gets frustrated because he does not get his way. Then the remainder of the board gets all anal-puckered and you can tell that they just wish I would go away. But I am not going to vote to spend money on every little whim.

They generally want what is good for the 'hood ...but one of them kinda thinks the HOA is the 4th branch of government.

I never thought I would be on an HOA board, but I am glad I did so I have a say in overseeing how the dues are spent.

I could write a book about my board, but I guess generally they mean well. I guess it could be worse.

HOAs do serve a purpose but can go overboard. They are a little democracy. When my HOA recently put in speed humps, they were careful to make sure it was the will of the majority of residents. In this case they were really needed. Yuppies don't have enough sense to slow down in a residential neighborhood. Not even their own [rolls eyes].

Hopefully you will bring some sanity to your neighborhood. Mine is actually pretty nice with moderate intervention. Our HOA president is actually a good guy. He told me most calls he gets are for barking dogs. All it took was one call to the police to quiet down the yappers on my street.
